Page 29 <br />copy of the cancellation notice, unless Contractor’s policy(ies) contain a provision that <br />coverage afforded under the policy(ies) will not be canceled without at least 30 days <br />advance written notice to the City of St. Anthony, or 10 days notice for non-payment of <br />premium; <br />¨The Contractor is responsible for payment of Contract related insurance premiums and <br />deductibles; <br />¨If the Contractor is self-insured, and self-insurance is allowed by the City if St. Anthony, a <br />Certificate of Self-Insurance must be attached; <br />¨The Contractor’s policy(ies) shall include legal defense fees in addition to its liability policy <br />limits. <br />¨Contractor shall obtain insurance policy(ies) from the insurance company(ies) having an <br />“AM BEST” rating of A- (minus); Financial Size Category (FSC) VII or better, and authorized to <br />do business in the State of Minnesota; and <br />¨An Umbrella or Excess Liability insurance policy may be used to supplement the Contractor’s <br />policy limits to satisfy the full policy limits required by the Contract. <br />20.1.5.Certifications of Insurance <br />The successful responder is required to submit Certificates of Insurance acceptable to the City of St. <br />Anthony as evidence of insurance coverage requirements prior to commencing work under the <br />contract. Thereafter, the Contractor shall annually provide Certificate of Insurance to the City of St. <br />Anthony that the insurance required by this contract is in effect, <br />20.2.Environmental <br />Contractor shall provide Environmental Impairment Liability (Pollution Legal Liability) for sudden <br />and non-sudden (gradual) pollution occurrences covering all facilities and equipment owned and <br />used by Contractor, or its agents or employees. Limits of liability shall be no less than $2,000,000 <br />for each occurrence and $2,000,000 aggregate and shall continue for a two-year period following <br />termination of this Contract. <br />20.3.City as Additional Insured <br />The CommercialGeneral, Auto, and Environmental insurance policies shall provide for the City as an <br />additional insured party. <br />20.4.Deductibles <br />All responsibility for payment of any sums resulting from any deductible provisions, corridor, of self- <br />insured retention conditions of the policy or policies shall remain with Contractor. <br />21.TERMINATION <br />The City reserves the right to immediately terminate the contract if the Contractor does not comply <br />with the insurance requirements and fails to cure the issue within 10 days from such notice and <br />144
