Planning Commission Regular Meeting Minutes <br />December 19, 2023 <br />Page 2 <br />1 zoned LI (Light Industrial) and is surrounded by other Industrial parcels and business tenants <br />2 along Anthony Lane. <br />3 <br />4 The proposed use would be a commercial Adult Daycare business, listed as a Conditional Use <br />5 in the LI District. The applicants noted that the use supports adults with disabilities and <br />6 special needs from the surrounding areas. The applicant has stated that the use would operate <br />7 during daytime and weekday hours (primarily 9:00 a.m. to 3:00 p.m.)_with most of the clients <br />8 arriving via automobiles operated by the facility’s employees. Vans may eventually be added <br />9 to support the employee automobile transportation. <br />10 <br />11 A Conditional Use Permit may be granted after determining that: <br />1.12 The use is one of the conditional uses specifically listed for the district in which the <br />13 property is located; <br />2.14 The City Council has specified all conditions which the City Council deems necessary to <br />15 make the use compatible with other uses in the area; <br />3.16 The use will not be detrimental to the health, safety, or general welfare of persons residing <br />17 or working in the vicinity or to the values of property in the vicinity; and <br />4.18 The use will provide a service or a facility which is in the interest of public convenience <br />19 and will contribute to the general welfare. <br />20 <br />21 The space is an existing building with attendant parking and circulation space. The building’s <br />22 exterior would not be modified, and only internal remodeling to accommodate the proposed <br />23 use would be necessary. Employee parking would be available in the parking field southwest <br />24 of the building (to the front). The applicants indicate a capacity of 100 adults being served, <br />25 with an employee ratio of 10 clients to 1 employee, resulting in a staff capacity of <br />26 approximately 10 employees. The current parking lot capacity can accommodate more than 50 <br />27 passenger vehicles. <br />28 <br />29 Staff has reviewed the project for land use compliance with the intent and policies of the <br />30 City’s Comprehensive Plan, and for zoning consistency with the “LI” District as a baseline. <br />31 The Comprehensive Plan promotes use of the subject property that reflect the proposed <br />32 commercial uses in the area. The proposed Conditional Use Permit meets the requirements of <br />33 the Zoning Ordinance for the baseline district zoning standards. Staff recommends approval of <br />34 the Conditional Use Permit to allow the proposed Adult Daycare facility in the proposed <br />35 location. <br />36 <br />37 Staff recommends approval with the following conditions: <br />1.38 Issues related to building, fire, and other related city codes shall be subject to comment <br />39 and recommendation by applicable staff. <br />2.40 The applicant receives, and provides to the City, the required licensing from the State of <br />41 Minnesota and provides evidence of such licensing throughout occupancy in the space. <br />3.42 The CUP is provided for the requested site only. Changes in location, size, operation, or <br />43 other aspects of the facility will require a new CUP application. As proposed, the capacity <br />44 of the facility would be 100 clients. <br />45
