The changes and/or discussion notes are <br />added to the draft ordinance and highlighted for ease of interpretation. <br />There were a few other clerical changes that were recommended, but which did not involve <br />substantive language. The Planning Commission unanimously passed a recommendation to <br />send the proposed ordinance to the City Council with changes to the proposed text as noted in <br />the redline draft, attached. <br />PROPOSED ORDINANCE SECTIONS <br />Section 1. Consolidates a variety of limits for outdoor noise generation to a consistent time, <br />requiring no excessive noise creation between 9:00pm and 7:00am. <br />Section 2. Establishes a more quantifiable definition for landscape screening when it is required <br />by either the Code or by Council action. <br />Section 3. Deletes parking references from the Nuisance section (these parking requirements <br />were updated and established as a separate section in a prior amendment, now codified as <br />Section 152.179). <br />Section 4. Creates a definition for “rodents”, which are then regulated in the subsequent <br />sections. NOTE: the language was taken from other code examples – the Commission <br />discussed the inclusion of chipmunks and squirrels in this list, and recommended no change. <br />Section 5. Adds a prohibition on rodent harborage for Owner/Landlords. <br />Section 6. Adds a prohibition on rodent harborage for renter/occupants. <br />Section 7. Moves Nuisance Automobile language into a related public health nuisance section. <br />Section 8. Adds a process requirement for Abandoned Sign removal (currently there is a <br />definition and prohibition, but no specific consequence). <br />Section 9. Adds an specific allowance for refuse container screening structures – now allowed <br />in the front yard – to be constructed of prefabricated materials, rather than the prior inference <br />that they be custom-built. <br />Sections 10. and 11. Consolidates adult- and child-care centers a Conditional Uses in the C, <br />Commercial and LI, Light Industrial Districts – current language is inconsistent. <br />Sections 12. and 13.
