MEMORANDUM <br />To:Mayor Webster and St. Anthony Village City Council <br />From:Stephen Grittman, City Planner <br />Date:City Council Meeting – March 26, 2024 <br />GC Project No.140.00 <br />Request:General Code Amendments <br />Property Address: NA <br />Property PID:NA <br />PROJECT DESCRIPTION <br />The attached ordinance presents a series of proposed code amendments for the City Council’s <br />second reading. Per the Council’s review and discussion of the material at the first reading, <br />updates have been made to a few of the sections. Primarily, those comments included the <br />following: <br />Section 1. Nuisance Noise - The Council suggested that consistency within the ordinance’s noise <br />limits is an appropriate objective, and that differentiation between noise sources (as suggested <br />by the Planning Commission) was relevant, but consistency was relevant. As such, all hours of <br />nuisance noise impacts were set to between 10:00pm and 7:00am. It is noted that the <br />nuisance noise ordinance limitations of this section are enforced on a complaint basis, and <br />unreasonable nuisance noise would continue to be a violation of Code. <br />One exception was made for Refuse Hauling (Section V(2)b. of the Ordinance). This section <br />specifies hours of 7:00am to 8:00pm, weekday or weekend/holiday, which is the time that is <br />required by the City’s contract with its refuse haulers. <br />Section 2. Landscape Screening – no changes. <br />Section 3. Nuisance Storage – the exception in this section for front-yard seasonal residential <br />recreational equipment was modified to reflect the 10:00pm to 7:00am limitations for both <br />noise, and for lighting. <br />Section 4. A new Section was inserted based on staff feedback, which incorporates a reference <br />to the residential recreational equipment in the Nuisance Storage section to enhance the ability <br />for users of the code to find relevant information. <br />101
