This section was amended to provide <br />clarification that intentional accumulations of vegetation for feeding of wild birds, and compost <br />structures that comply with City Code, are exempt from the prohibitions of this section. <br />Section 7 – 14 (formerly 6-13): No further changes. <br />The code sections are summarized below as they were originally discussed with the Planning <br />Commission. To assist in the Council’s discussion and review of the second reading, additions <br />or changes to the first reading text are highlighted in yellow. <br />CITY COUNCIL ACTION <br />This is the second of three readings of the proposed ordinance. The Council is asked to <br />comment on any elements of the language, and move the ordinance to its third and final <br />reading, at which point the Council may adopt the Ordinance as it is presented or amended in <br />final form. <br />PRIOR PLANNING COMMISSION ACTION <br />The Planning Commission considered the proposed elements of the Ordinance at a public <br />hearing during its regular meeting on February 20, 2024. The Planning Commission discussed <br />the various sections and noted that there was nobody from the public to comment on the <br />amendments. Their discussion included comments in the staff report (reproduced below) <br />noting potential policy or technical issues for review. <br />The primary discussion related to the hours during which additional noise regulations were to <br />be enforced (Section 1 of the proposed ordinance). The current ordinance has a variety of start <br />and/or end times for a night-time quiet period. The draft ordinance proposed consolidating <br />those times, regardless of noise source. The Commission’s discussion (and recommendation) <br />altered the draft ordinance to retain the current 10:00p deadline for music-related sound, and <br />also to retain the current distinction between weekday and weekend morning quiet times <br />(retaining the current 9:00a.m. rather than modify it). The changes and/or discussion notes are <br />added to the draft ordinance and highlighted for ease of interpretation. <br />There were a few other clerical changes that were recommended, but which did not involve <br />substantive language. The Planning Commission unanimously passed a recommendation to <br />send the proposed ordinance to the City Council with changes to the proposed text as noted in <br />the redline draft, attached. <br />PROPOSED ORDINANCE SECTIONS <br />Section 1. Consolidates a variety of limits for outdoor noise generation to a consistent time, <br />requiring no excessive noise creation between 9:00pm and 7:00am. <br />102
