City Council Regular Meeting Minutes <br />March 26, 2024 <br />Page 3 <br />1 for the location and site as proposed, with need only for annual administrative review, <br />2 provided no expansion or other substantive changes are proposed. <br />3 <br />4 This recommendation is based on a finding that the proposal, with the conditions cited, is <br />5 consistent with the requirements for Conditional Use Permit consideration, with the long-term <br />6 objectives of the recommendations and policies of the St. Anthony Comprehensive Plan. <br />7 Attached for Council’s consideration were Location Map, Application and Supporting Material, <br />8 and Resolution 24-023. <br />9 <br />10 Councilmember Doolan stated she frequents both garden centers and asked if there are shut off <br />11 valves for the water sources should they be found to have leaking hoses. <br />12 <br />13 Mr. Camilo Ogando, owner of Garden City Greenhouses stated they try to minimize their water <br />14 usage and he will do his best regarding the shut off valves. <br />15 <br />16 Mayor Webster asked how long the garden center has operated in St. Anthony and Mr. Ogando <br />17 stated since 2016. Mayor Webster thanked him for having his business in St. Anthony. <br />18 <br />19 Councilmember Doolan asked since Linder’s is closed where are the plants sourced from. Mr. <br />20 Ogando stated from Lake Elmo and Dayton. <br />21 <br />22 Motion by Councilmember Doolan, seconded by Councilmember Stephens, for approval of <br />23 Resolution 24-023 – Approving a Request for a Conditional Use Permit for a Temporary <br />24 Building and Seasonal Garden Facility in the C-Commercial District – 2900 Pentagon Drive. <br />25 <br />26 Motion carried 4-0. <br />27 <br />B.28 Resolution 24-024 – Approving a Request for a Conditional Use Permit for a Temporary <br />29 Building and Seasonal Garden Facility in the C Commercial District – 3930 Silver Lake <br />30 Road. <br />31 <br />32 City Planner Grittman reviewed the Planning Commission considered the proposed Conditional <br />33 Use Permit at a public hearing during its regular meeting on March 19, 2024. The <br />34 applicant/operator was not present at the meeting to answer questions from the Commission, nor <br />35 were other members of the public. <br />36 <br />37 The Commission discussed the proposed use, noting that it had existed largely in the same <br />38 location and nature of operation in previous years, without apparent incident or issue. Questions <br />39 were raised as to the restroom facilities available to employees the applicant is the tenant on the <br />40 subject property – Cub Foods, which can grant approval for the garden center operator and its <br />41 employees to utilize store facilities. The Commission noted that any future utilization of <br />42 temporary portable restroom facilities would require staff approval, presuming compliance with <br />43 the requirements of the City Code. <br />44 <br />45 Mr. Grittman stated the applicant is seeking approval of a Conditional Use Permit to erect and <br />46 operate a temporary garden center as a commercial use on the property at 3930 Silver Lake Road <br />47 <br />11
