City Council Regular Meeting Minutes <br />March 26, 2024 <br />Page 4 <br />1 (Cub Foods property). The garden center would be set up and placed in the parking lot of the <br />2 center within the parking near the southeast corner of the grocery store, nearest the front access <br />3 road. Temporary structures such as this are specifically allowed as Conditional Uses, with a <br />4 series of conditions that relate to the site conditions and requirements for the facility, including <br />5 duration, signage and other operational elements. <br />6 <br />7 The Staff Analysis of the request was reviewed. Staff recommends approval with the following <br />8 conditions: <br />9 <br />1.10 Issues related to building, fire, and other related City Codes shall be subject to <br />11 comment and recommendation by applicable staff. This CUP is provided for land use <br />12 purposes only, and other applicable licenses or permits require separate application. <br />13 <br />2.14 The applicant receives, and provides to the City, operational information related to <br />15 utility services and any details related to use and location of portable restroom <br />16 facilities on the premises. If portable restroom facilities are proposed at some point in <br />17 the future, the applicant may provide information to the City and Staff shall have the <br />18 authority to approve a location consistent with the requirements of the City Code. <br />19 <br />3.20 The CUP is provided for the requested site only. Changes in location, size, operation, <br />21 or other aspects of the facility will require a new CUP application. The CUP, per the <br />22 allowances of the Zoning Ordinance relating to Temporary Structures, remains valid <br />23 for the location and site as proposed, with need only for annual administrative review, <br />24 provided no expansion or other substantive changes are proposed. <br />25 <br />26 This recommendation is based on a finding that the proposal, with the conditions cited, is <br />27 consistent with the requirements for Conditional Use Permit consideration, with the long-term <br />28 objectives of the recommendations and policies of the St. Anthony Comprehensive Plan. <br />29 Attached for Council’s consideration were Location Map, Application and Supporting Material, <br />30 and Resolution 24-023. <br />31 <br />32 Councilmember Doolan added she wants to make sure there is a process in place to minimize <br />33 water leaks if detected after hours. <br />34 <br />35 Councilmember Jenson stated this greenhouse setup has been in St. Anthony for at least 25 years <br />36 and is well maintained. He cited the same for the previous location request. <br />37 <br />38 Motion by Councilmember Jenson, seconded by Councilmember Doolan, for approval of <br />39 Resolution 24-024 – Approving a Request for a Conditional Use Permit for a Temporary <br />40 Building and Seasonal Garden Facility in the C-Commercial District – 3930 Silver Lake Road. <br />41 <br />42 Motion carried 4-0. <br />43 <br />44 VI.GENERAL BUSINESS OF COUNCIL. <br />45 <br />A.46 Police Annual Report. <br />12
