City Council Regular Meeting Minutes <br />May 14, 2024 <br />Page 2 <br />A. Resolution 24-035 — Resolution Approving a Request for a Conditional Use Permit for <br />Modifications to a Restaurant Drive -Through in a "C", Commercial District <br />City Planner Grittman reviewed the resolution with the Council and indicated that the applicants <br />are seeking a Conditional Use Permit to modify an existing drive -through facility on the Culvers <br />Restaurant property to add a formal second order/stack lane, and make some modifications to <br />parking and traffic flow resulting from the change. Restaurants with drive -through facilities are <br />allowed in the C-Commercial District by Conditional Use Permit provided they comply with the <br />requirements of the terms of the Conditional Use reviews and code requirements. <br />T <br />11 City Planner Grittman explained that for this project, the applicant will make only a few <br />12 construction changes to the site, with the primary access points remaining untouched (an internal <br />13 private street on the south and a right -in, right -out driveway from Silver Lake Road on the west). <br />14 Internal circulation will be modified, however, resulting from two new medians installed to <br />15 separate drive- through ordering and pick-up traffic, and a change to the circulation flow — <br />16 creating a one-way counter -clockwise circulation on the north and east sides of the property from <br />17 what is currently a two-way pattern. The one-way circulation change reconfigures 90 degree <br />18 parking on the north and west boundaries to a combination of 11 angled spaces and 5 parallel <br />19 waiting spaces for pre -order customers — reducing overall parking on the site by approximately <br />20 16 spaces. A small change to an existing curb island is also included to manage waiting spaces at <br />21 the exit portion of the site. <br />22 <br />23 City Planner Grittman stated the Council is asked to consider Resolution 24-035 approving a <br />24 Conditional Use Permit for modifications to a drive -through facility for Culver's at 4004 Silver <br />25 Lake Road based on a finding that the proposed use is consistent with the requirements of the <br />26 Zoning Ordinance, incorporating the conditions of approval therein. <br />27 <br />28 City Planner Grittman noted the Planning Commission reviewed the proposed Conditional Use <br />29 Permit request at a public hearing held on April 16, 2024. There was no one in attendance at the <br />30 hearing, and no written submissions were received from members of the public. The <br />31 Commission queried staff on details of the plan, including options for future changes if needed. <br />32 The recommended terms suggest that ongoing review of parking demand and supply are subject <br />33 to review if needed. <br />34 <br />35 Representatives of the applicant were present, and spoke to the changes to the site and to the <br />36 facility overall. They noted an increase in drive -through use, and the sufficiency of parking for <br />37 staff and dine -in customers. After consideration, the Planning Commission voted unanimously to <br />38 recommend approval of the Conditional Use Permit, with the conditions listed in the Staff report. <br />39 <br />40 City Planner Grittman stated staff has reviewed the project for land use compliance with the <br />41 intent and policies of the City's Comprehensive Plan, and for zoning consistency with the <br />42 Commercial District as a baseline. In summary, the Comprehensive Plan supports commercial <br />43 uses in this area.
