Ordinance 2024-03 — Amending the St. Anthony City Code by Amending Title XI <br />2 Section 152.188 Relatingto o Regulation of the Sale and Distribution of Cannabis <br />3 Products. <br />4 <br />5 City Planner Stephen Grittman reviewed the Council considered the first reading of amendments <br />6 to the Zoning Ordinance related to cannabis retailing at its regular meeting on June 11, 2024. A <br />7 second reading was held on June 25, 2024. The Council discussed aspects of the proposed <br />8 ordinance, with modifications to the original draft language. Those modifications included the <br />9 inclusion of residential substance abuse treatment centers to the list of land uses that would be <br />10 included in the separation buffers being created by the Code; and an increase in the proposed <br />11 separation buffer for child care centers to 300 feet, from the Planning Commission's <br />12 recommendation of 100 feet. <br />13 <br />14 The second reading incorporated those amendments, which are now included in the third and <br />15 final reading in ordinance form. <br />16 <br />17 The language of the code recommends that the separation from treatment centers to be listed as <br />18 "licensed" centers by the State of Minnesota. The City has the ability to research properly <br />19 licensed facilities and make an informed judgment about distance and registration. There are <br />20 some "treatment" facilities that operate as "sober houses" or other similar unlicensed <br />21 programming which would not be trackable. Staff has inserted a 300 foot separation buffer for <br />22 these uses in the proposed language. <br />23 <br />24 Staff requests that the City Council approve the third reading of the attached Ordinance No. <br />25 20244-03, adopting the ordinance in final fonn. <br />26 <br />27 Staff continues to recommend that the moratorium ordinance enacted last August continue in <br />28 force as further materials are generated by the State of Minnesota over the next several months. <br />29 <br />30 Also provided for Council consideration were the State Law — Local Control and a Map of <br />31 Separation Distance Impacts. <br />32 <br />33 Councilmember Jenson stated there was a lot of discussion on this Ordinance previously. <br />34 <br />35 Mayor Webster stated she appreciates hearing the State boundaries along with the discussion. <br />36 <br />37 Councilmember Doolan asked if this would help if we were to encounter illegal dispensaries <br />38 within the City. Mr. Grittman stated that would be a law enforcement process not a zoning <br />39 violation. <br />40 <br />41 Motion by Councilmember Doolan, seconded by Councilmember Jenson, to approve Third <br />42 Reading and Adopt Ordinance 2024-03 Amending the St. Anthony City Code, by Amending <br />43 Title XI, Section 152.188 Relating to Regulation of the Sale and Distribution of Cannabis <br />44 Products. <br />45 <br />46 Motion carried 4-l(Randleh <br />
