ORDINANCE NO. ___ <br /> <br />3 <br /> <br /> <br />1. There shall be a license fee and late renewal fee as established by the <br />City Fee Schedule in Section 33.XX. All fees and fines shall be <br />charged to and payable by the property owner. <br />2. Pursuant to Minnesota Statutes, section 469.190, local lodging taxes <br />may be collected on all rentals less than 30 days in length in <br />accordance if so adopted by the City Council. <br />3. Short-Term Rentals in violation of this ordinance may be subject to <br />license suspension or revocation and administrative fines, in addition <br />to any other fees or penalties per Section 33.XX or other applicable <br />sections of City Code. <br /> <br />(F) MANNER OF LICENSURE: <br /> <br />1. Any Short-Term Rental Unit in existence prior to the adoption of this <br />Ordinance, has been operation outside of the City Code licensing and <br />zoning provisions. No such prior Short Term Rental Unit shall <br />continue without securing and maintaining the required license under <br />this Section, and complying with the terms herein. <br /> <br />2. An owner of a property that after the effective date of this Chapter <br />wishes to convert the property into a Short-Term Rental property, shall <br />apply for and license the property prior to its conversion. <br /> <br />3. If there is a change in the type of occupancy from the type stated on <br />the license form, an amended license form shall be filed within 30 <br />days of the change. <br /> <br />4. When a previously licensed property is sold, the new owner, if <br />continuing to offer Short-Term Rental, shall apply for a license within <br />30 days of the sale and may not allow occupancy as a short-term rental <br />until a license has been obtained. No license issued to a prior owner <br />shall transfer to any new owner of said property. <br /> <br />5. Valid Short-term rental license holders shall not be required to register <br />said rental per this Section if they enter into rental lease periods <br />totaling at least thirty (30) consecutive days. However, such a change <br />in rental terms shall require notice to the City that such license is to be <br />converted to a rental housing license subject to the requirements of <br />Section 152. <br /> <br />6. The City Manager may administratively deny a license under this <br />Chapter if the property has been issued fines for repeat nuisance <br />violations per City Code Section XX. <br /> <br />7. If a person is found to have engaged in rentals that require a license <br />under this Chapter, but no license has been obtained, upon application <br />for licensure said license shall not become effective for 90 days. <br />17
