March 11, 2025 St. Anthony Council Work Session - 2 <br /> <br /> <br />Minnesota Statutes Section 342.13 and 342.22. At that point, local governments will issue local retail <br />registrations to businesses with cannabis and hemp businesses licenses issued by OCM. <br /> <br />Staff is recommending that the Council take no action to amend Section 117.16 as previously proposed. <br />Staff will continue to monitor the actions and directives that OCM implements specific to Minnesota <br />Statutes Section 342-13 and 342.22 and when appropriate, present language to Council eliminating the <br />requirements for local licensing. <br /> <br />Councilmember Randle stated the Council had not decided this was something they wanted to do. It was <br />not a Council decision. We were under the assumption that Council could control who got licenses <br />within the City. Mr. Sonterre stated that since the Office of Cannabis Management will handle licensing <br />for THC and Cannabis sales. Cities have control over distances and numbers of licenses. Vendors still <br />need to meet other code requirements of the City. <br /> <br />Mayor Webster stated a year and a half ago, Council was trying to determine how to handle retailers <br />who want to sell THC-based products to sell edibles (for those with a tobacco license), and if they had a <br />liquor license they could serve THC-infused products. <br /> <br />Councilmember Jenson stated Council has control in that they can establish locations but in restaurants <br />10 mg products can be sold. He asked if edibles could be sold in restaurants also. Mr. Sonterre stated <br />tobacco retailers could sell edibles. The question is can they sell liquid-based products. Councilmember <br />Jenson asked if a restaurant could sell beverages and Mr. Sonterre stated they could but they could not <br />sell edibles. <br /> <br />Councilmember Doolan asked when the takeover will occur. Mr. Sonterre stated they will be rolling out <br />the cannabis licenses first, and the THC products afterwards, possibly September. <br /> <br />Councilmember Jenson asked if we can continue to do business as normal and Mr. Sonterre stated yes <br />at the locations where they are currently being sold. <br /> <br />Ordinance 2025-02 – General Code Updates <br /> <br />City Planner Steve Grittman reviewed that the ordinance provided presents a series of proposed code <br />amendments for consideration and discussion. These have been generated primarily through a review of <br />the existing (and recodified) City Code. The Planning Commission held a public hearing on the zoning <br />items, but this list includes both zoning and general city code amendments for review prior to final <br />adoption. Many of these are thought to be clerical, but some policy issues are raised. The code sections <br />modified were provided for Council review in the form of Ordinance 2025-02. <br /> <br />The Sections were reviewed one at a time with Council comments noted. <br /> <br />Section 1 – This clause enables the City to set an appropriate penalty fee as a part of the City’s fee <br />schedule, which is typically adopted and updated on an annual basis. <br /> <br />Section 2 – The text of the definition does not change, with the exception that a clause is added to <br />clarify that retaining walls must meet the requirements of other fences, consistent with current practice. <br /> <br />Section 3 – This change updates the City’s recently adopted natural landscape language (from 2023) to <br />be consistent with the even more recently adopted State statutory language from 2024.
