Given the restrictions in buildable area, no reasonable construction would fit on the 1 <br />property, including parking and other site improvements, without flexibility in 2 <br />setbacks and building location. 3 <br />7. The conditions on the property noted herein support the reasonable use of the property 4 <br />as an assisted living facility with a narrower side yard setback. 5 <br />8. The nature of the use creates a demand for parking that is much lower than what 6 <br />would otherwise by required for underground parking supply on a site. 7 <br />9. The development of underground parking for the facility would constitute a wasted 8 <br />cost given the low parking demand for assisted living units. 9 <br /> 10 <br />Mr. Grittman provided alternative Planning Commission action with either a Motion to 11 <br />recommend denial of the CUP and/or Variances. In the event of a recommendation for denial, 12 <br />the Planning Commission must state its findings related to denial on the record or the 13 <br />Planning Commission may request additional information and table action. A motion to table 14 <br />should be accompanied by the specific information requested of staff or the developer 15 <br />necessary to make a recommendation. Also provided for Commission review were the 16 <br />Application and Supporting Material, PH Notice – CUP – Foss Road and a draft City Council 17 <br />Resolution. 18 <br /> 19 <br />Commissioner Hark asked what the history is of that site. Mr. Grittman stated there are no 20 <br />easements or impediments for the removal of the building from the property. Mr. Grittman 21 <br />stated he is not an expert on the history of that site. 22 <br /> 23 <br />Commissioner Corneille referred to the adjacent property to the south that have multi-family 24 <br />residential. He asked if those buildings needed variances. Mr. Grittman stated that those 25 <br />buildings have been there for quite some time. Commissioner Corneille asked if a similar 26 <br />building could be constructed on that site and Mr. Grittman stated not due to the lot size. 27 <br />Commissioner Corneille asked if there is a definition for assisted living, and Mr. Grittman 28 <br />will check that. Commissioner Corneille asked if the setback variance is just to the south, and 29 <br />Mr. Grittman stated that is true. 30 <br /> 31 <br />Commissioner Mayne asked if the variance is for unique conditions to the property or to the 32 <br />business and Mr. Grittman stated the question is whether this is a reasonable use on the 33 <br />property. 34 <br /> 35 <br />Commissioner Anderson asked if the emergency lane would take away from the existing 36 <br />street parking and Mr. Grittman stated it would. She asked for information on the 37 <br />sustainability goals and if they are in the City Code. Mr. Grittman stated this relates to items 38 <br />such as solar rooftop and other items relating to GreenStep within the City. 39 <br /> 40 <br />Chair Socha asked if there is more parking added reducing impervious surfaces, would 41 <br />another variance be needed. Mr. Grittman stated the plan would not affect the impervious in 42 <br />any way. There will be a turnaround space at the end of the parking lot. If it goes above the 43 <br />50% coverage a separate variance would be needed. 44 <br /> 45
