Draft Ordinance Planning Commission Comment Staff Comment <br />Sections 1 and 2. <br />Section §154.007 DEFINITIONS <br />(Zoning) and §152.05 DEFINTIONS <br />(Rental Housing) amended to add <br />the following: <br />RESIDENCE OR RESIDENTIAL USE: A <br />dwelling unit that is intended for <br />occupancy for no less than 30 <br />consecutive days, whether owned or <br />rented. <br />SHORT-TERM RENTAL UNIT: A form <br />of transient occupancy, similar to <br />motels or other such uses, in a <br />residential zoning district for which <br />occupancy of a residential building, <br />room, or suite of rooms is offered, <br />rented, or used, for periods of fewer <br />than 30 consecutive days. <br />MOTEL (Includes <br />“HOTEL”). Premises furnishing <br />sleeping or overnight stopping <br />accommodations for travelers and <br />other transient guests for stays of <br />fewer than 30 consecutive days. <br />No specific discussion; However, <br />Planning Commission’s intent would <br />be to redefine terms to <br />accommodate Short-term rental <br />housing in residential areas. <br />Commission voted to table these <br />sections of the code to further <br />discuss and allow Short-term rental <br />housing. <br />The Commission’s comments <br />focused on the idea that well-run <br />short-term rentals could be an asset <br />to the community. One member of <br />the public was present (and <br />submitted written materials) to <br />express support for allowing short- <br />term rental housing. <br />Section 3. Section §154.051 (A) is <br />hereby amended to read as follows: <br />(A)Single-family detached <br />residential dwellings, but not <br />including short term rentals; <br />Same note as above.Sections 3-9 explicitly <br />exclude short term <br />rental housing from the <br />allowed residential use <br />in the various zoning <br />districts. <br />Section 10.Section §152.08 is <br />hereby amended to read as follows: <br />(A) LICENSE REQUIRED. It is <br />unlawful to operate a rental <br />dwelling in the city without first <br />having obtained a license from the <br />city. An owner must obtain a license <br />for each rental dwelling. If the rental <br />dwelling contains two or more units, <br />and has a common owner and a <br />common property identification <br />number, the owner may obtain a <br />single license for the rental dwelling. <br />No changes (existing language).
