Planning Commission Regular Meeting Minutes <br />July 15, 2025 <br />Page 4 <br />1 Mr. Grittman reviewed the Planning Commission considered regulations related to rental <br />2 housing at a public hearing in June 2025. The Commission discussed several sections of a <br />3 draft ordinance related to both short-term and long-term rental housing in the Village. The <br />4 Commission expressed any interest in further discussing short-term rentals and tabled action <br />5 on those aspects of the proposed ordinance. <br />6 <br />7 The ordinance developed by staff under consideration was reflective of the City Council’s <br />8 direction, generated at a prior work session and other meetings, that short-term rental housing <br />9 should be prohibited. This direction was again reflected in the Council work session on rental <br />10 housing on July 8, 2025. <br />11 <br />12 The draft ordinance sections related to short-term rental housing are again before the Planning <br />13 Commission. There were a variety of questions and comments made by the Planning <br />14 Commission on this aspect of rental housing, which were relayed both through the recording <br />15 of the Commission’s meeting and summarized by staff for work session review. Although the <br />16 Commission raised several items, focused on an allowance for short-term rentals and how to <br />17 regulate it, the City Council reaffirmed its lack of support. <br />18 <br />19 Mr. Grittman resubmitted the tabled aspects of the rental housing ordinance for Planning <br />20 Commission considerations related to short-term rentals. The proposed language has the effect <br />21 of explicitly prohibiting this land use on residential property. <br />22 <br />23 For short-term rentals, the central question is whether the Commission recommends approval <br />24 or denial of the proposed ordinance. <br />25 <br />26 It is further noted that under general zoning law, the City has up to 120 days to consider and <br />27 finalize its action on a zoning request. As such, the common expectation is that the Planning <br />28 Commission will forward its recommendation to the City Council within 60 days, ensuring <br />29 the Council has adequate time to deliberate on the proposal. As such, staff would note that the <br />30 Commission should provide its recommendation at its July 15 meeting. <br />31 <br />32 Chair Socha noted that the Planning Commission at their last meeting suggested that the long- <br />33 term rentals be capped at 10% and the short-term rentals could be no more than 1.5% of the <br />34 cap. The City Council was not inclined to agree. <br />35 <br />36 Commissioner Hark asked if any of the current short-term rentals within the City have a rental <br />37 license. Mr. Grittman stated he believes some of them may have a rental license. <br />38 Commissioner Hark asked if the City collects any transient occupancy tax on these rentals, <br />39 and Mr. Grittman stated the City does not have a transient occupancy tax. <br />40 <br />41 Mr. Paul White, 32nd Avenue, owns a rental property that has been licensed for rental for over <br />42 10 years, and it has been operated as a short-term rental. They reviewed the ordinance and <br />43 understood it was ok to operate a short-term rental. It is an amenity for the neighborhood, as <br />44 several neighbors use it for families coming into town. His family uses it. He provided <br />45 comments at the last meeting, also.
