Since the discussion has been held to prohibit short-term rentals within St. <br />2 Anthony, he has asked a law firm to investigate it, and he is confident they are acting legally <br />3 now, and there is nothing in the code that clearly states a short-term rental is not allowed. He <br />4 believes his property rights are being taken away and that his investment in the property. <br />5 Permitting and inspections are good for the City. Perhaps penalties should be put in place if <br />6 short-term rentals are not handled correctly. <br />7 <br />8 Commissioner Anderson asked if current owners would be grandfathered, and Mr. Grittman <br />9 stated the ordinance would not grandfather any current short-term rentals. The code has not <br />10 allowed them because they did not have a legal establishment when they began operating. If <br />11 the City were to allow for current short-term rentals to continue, an exclusion would need to <br />12 be written into the code. Ms. Morello stated based on the July 8 work session, the Council is <br />13 not interested in allowing current short-term rentals to continue. <br />14 <br />15 Commissioner Hark asked if the code had never stated 30 or more consecutive days until this <br />16 proposal. Mr. Grittman stated that the City’s position is relying on statutory language. <br />17 <br />18 Chair Socha stated she does not like the idea of short-term rentals taking all the rental licenses <br />19 since we have a cap. There is a need for the rental of residential units. She does not see a <br />20 problem with some. She likes the proposal that the Planning Commission came up with last <br />21 time. We are unable to grandfather current short-term rentals as they were never compliant <br />22 with the City code. Having a very low cap would allow for some short-term rentals within the <br />23 City and provide an opportunity for those with existing rental licenses to continue using it <br />24 within 1.5% of the 10%. It is so small that it would not cause negative effects that people are <br />25 worried about. The administrative burden seems worth it in tracking. <br />26 <br />27 Commissioner Erickson stated he supports the ordinance with the addition of a caveat making <br />28 an exception for a short-term rental property where the owner owns the adjacent property. <br />29 <br />30 Commissioner Anderson feels it is an amenity for St. Anthony. If this cannot be grandfathered <br />31 in, she would support the small percentage. She does not feel it is fair to take current short- <br />32 term rentals with this ordinance. <br />33 <br />34 Commissioner Morita is against overregulation of property owners' rights in the City and <br />35 would not support the ordinance as it is amended. <br />36 <br />37 Commissioner Hark stated she has worked with the licensing of short-term rentals and has a <br />38 different perspective on this. She said short-term rentals do not support the City’s housing <br />39 goals, as these rentals could be owned by first-time homeowners or rented long-term for <br />40 people needing housing within St. Anthony. She knows that if licensed and regulated <br />41 properly, nuisances can be avoided for short-term rentals and be part of our community. They <br />42 may be maintained better than single-family owned homes or rented single-family homes. <br />43 Turnover is high, but the home is constantly being maintained. The Code can be written so <br />44 that it only allows good owners/operators like Mr. White. It could avoid people who are trying <br />45 to make quick money and bring people in/out of the City.
