MEMORANDUM <br />To:Saint Anthony Village City Council <br />From:Stephen Grittman, City Planner <br />Date:July 14, 2026 <br />Request: Review of Proposed Accessory Dwelling Unit Ordinance <br />BACKGROUND <br />The proposed ADU ordinance amendment arose from prior discussions of housing in Saint Anthony <br />Village, and opportunities to add density, but in a way that was respectful of the Village’s neighborhood <br />character. The ordinance proposes an allowance for Accessory Dwelling Units (ADUs). The material is <br />presented in a tabular format similar to the Council’s initial review. The ordinance text and <br />accompanying staff comment is provided on each section, as well as a more formal ordinance form – the <br />ordinance language is duplicated, but without the accompanying staff comments. <br />The Planning Commission held a public hearing to review and make recommendations on the original <br />draft at its regular meeting on June 16, 2026. <br />PLANNING COMMISSION PUBLIC HEARING <br />The following are a summation of the Planning Commissions comments: <br />1.Reanalyze the occupancy and definition of family – what is intent of the ordinance. The <br />Commission debated the occupancy language, supporting a less restrictive limitation on the age <br />of the occupants. Staff comment: The ADU draft is intended to allow limited additional <br />occupancy – limits of two adults (relationship undefined) is the purpose. Allowance for minor <br />dependent children is an acknowledgment of family realities but not intended to open up a <br />small unit (by definition) to several adults – due to multiplicity of vehicles, need for open space, <br />other subsequent impacts of multiple adults. <br />2.Discussion was held around the accessory building allowance for 1,000 square feet of major <br />accessory building, compared to limitation of ADUs as attached structures only. Theoretically, a <br />property owner could build a detached accessory garage, and then convert that structure to <br />ADU. The Commission posed an allowance for a more expansive ordinance without many of the <br />limitations in this draft. Staff comment: While this is partially the case, only the maximum area <br />of 600 square feet could be converted to ADU space under the current draft. Opening up all lots <br />to separate structures would benefit from a more comprehensive view of housing density. It <br />would also implicate additional examinations of lot coverage, parking support, and other similar <br />impacts. <br />3.600 square feet maximum. Should there be interest in allowance of ADU space up to the size of <br />the principal dwelling? Staff comment: The point of ADU allowance is to be accessory in nature, <br />not essentially equal to the principal dwelling – that would be a two-family residence/duplex. <br />This would be a discussion that needs to be more extensively vetted as a part of the coming <br />Comprehensive Plan update. <br />19
