4.The Commission briefly discussed the ordinance’s counting of ADUs separately from total single- <br />family rentals. No change was proposed. <br />5.The Commission questioned whether an ADU would be allowed to house a licensed group <br />home. Staff comment: In further research, staff believe that a group home would not be eligible <br />for group home occupancy. A licensed group home is a principal use of property, rather than an <br />accessory use. This discussion, however, raises some potential challenges if the occupancy <br />allowance is opened to more than the 2 adults as written. <br />6.The Commission further discussed the appropriate direction of the ADU ordinance and whether <br />the draft is too restrictive, about right, or too accommodating? There was some opinion that <br />the ordinance should be broadened to be a more effective “right” of property owners, rather <br />than a limited accommodation. Although there was some variation in detail, the Commission <br />generally agreed that opening up the code to ADU allowance was an appropriate step. There <br />was interest in increasing the size allowance, however, that discussion implicated the <br />Commission’s other interest in eliminating the restrictions on age. <br />RECOMMENDATION <br />In summary, the Commission generally approved of the ordinance, with removal of the occupancy <br />language related to age or relationship. The increase in unit size beyond the 600 square foot size, if <br />allowed, would reintroduce the age restrictions. As such, the Commission’s action was to formally <br />recommend the Ordinance, striking the portion of Subp. (e) as follows: <br />(a)Floor Area. ADUs shall contain no less than 400 square feet of habitable space, and <br />a maximum of 600 square feet. Occupancies shall be limited to no more than 2 adult <br />occupants of 19 years of age or greater, along with dependent minor children less <br />than 19 years of age. All building codes shall apply to the ADU. In this regard, total <br />occupancy may be no greater than one person for the first 150 square feet, one <br />person per each additional 100 square feet. <br />For the work session, no action is required. Consensus is sought on ordinance language and possible <br />modifications in anticipation of subsequent formal consideration of Ordinance adoption. <br />NEXT STEPS <br />Following the Council’s discussion at this work session, the ordinance would be prepared for City Council <br />for three ordinance readings, which is standard practice based on the City Code. <br />ATTACHMENTS <br />Draft Ordinance Language – Table Form <br />Draft Ordinance 2026-XX <br />20
