STAFF REPORT 39 <br />To: Planning Commission Report No.:.--, VIL2 <br />From: Kim Moore -Sykes, Assistant: City Manager 06 <br />Date: May 17, 2005 V <br />Subject: Alderwoods Group -- Petition for Amendment to the Zoning Ordinance <br />Px, �opertyAddress: Sunset Memorial Park, 2250 St. Anthony Boulevard. <br />2^onin District: R-1 Single Family Residential; legal non -conforming <br />Requested Action_ Staff is asking the Planning Commission to review the proposed text amendment to <br />the City's Zoning Ordinance whereby Chapter 1.6, Section 1615.02 .is amended to permit cemeteries, <br />mausoleums, crypts, vaults, crematoriums, columbarium, and scattering grounds in the R-1 Single Family <br />Zoning District. Additionally, the text amendment would also include a change to Section 1615.03 whereby <br />funeral homes are allowed in the R-1 Zoning District as a permitted conditional use. <br />The proposed text amendment is as presented in Section #6 of the Sunset Funeral Home and Cemetery <br />Concept Review Submission dated April 19, 2005 and as follows with proposed changes indicated by <br />strikethroughs and underlines: <br />1605.01 Definitions. For the purpose of the Zoning Code, the following; terms and words have the <br />following meaning: <br />Subd. 32, Funeral Home. An establishment used. for uldertakirng services such as <br />preparing human deceased for burial, display of the deceased and. performing humanfaneral <br />services, sales and storage of funeral -related supplies and vehicles. <br />1615.02 Permitted Uses. Within an R-1 District, only the £ollowirng uses are permitted: <br />(e) cemeteries, mausoleums, crypts, vaults, crf-matr3r4ums and columbarium. <br />ai groand-s <br />1615.03 Permitted Conditional Uses, Within a R-1 District, the following uses are permitted only if a <br />conditional use permit has been issued by the City Council: <br />(d) funeral homes <br />Staff recommends that the proposed language be modified to remove crematoriums as a permitted use in <br />the R-1 District. Staff has also recommended a definition of funeral homes be added to the proposed text <br />amendment. The Alderwoods Group indicated that they are also interested in defining the minimum <br />acreage required for a designation of funeral home as part of the proposed language. If the proposed <br />changes to Sections 1615.03 and 1615.02 are agreed to, and based on the Findings of Pact from the public <br />hearing on this request Staff requests that the Planning Commission consider recommending approval of <br />the text amendment to the Zoning Ordinance to the City Council. <br />IL\Planning\Staff Reports\2005\Alderwoods Amendment to Ord Staff Repoa.doc <br />
