K <br />JOINT POWERS AGREEMENT BETWEEN <br />RAMSEY COUNTY AND CITY OF SAINT ANTHONY <br />FOR USE OF YARD WASTE MANAGEMENT SITES <br />This Agreement is entered into pursuant to Minnesota Statutes Section 471.59 on this .—day of <br />_ 2005 between Ramsey County (the "County"), a political subdivision of the State <br />of Minnesota, and the City of Saint Anthony (the "Municipality"), a political subdivision of the State <br />of Minnesota. <br />Whereas, Ramsey County operates a yard waste management system, which includes <br />seven sites for the collection of yard waste from Ramsey County residents; and <br />Whereas, YW Policy ##4 in the Regional/Ramsey County Solid Waste Master Plan states <br />that "Ramsey County will not allow residents of other counties or allow, commercial yard waste <br />haulers/collectors, lawn services, or tree services to use County yard waste sites," <br />Whereas, a portion of the City of Saint Anthony is within Ramsey County, and City <br />residents within that area may use the County's yard waste sites, but those City residents not in <br />Ramsey County are not allowed to use the County's yard waste sites; and <br />Whereas, The City would like to provide additional yard waste management opportunities <br />to all of its residents, whether they reside in Ramsey County or Hennepin County; and <br />Whereas, Ramsey County is willing to make yard waste services available to the City of <br />Saint Anthony for a reasonable cost, and provide an exception to YW Policy #4 to address the <br />practical difficulties of providing yard waste services for residents of the City because this <br />City has significant population in two counties. Now, therefore, it is agreed: <br />COUNTY OBLIGATIONS <br />a. The County shall allow all residents of the City, regardless of county of residence, to use <br />County Yard Waste sites at the same level of service that the sites are available to County <br />residents. <br />b. The County will monitor the use of the yard waste sites by City residents, noting the county <br />of residence of the residents using the sites, and will report to the City on a regular basis. <br />c. The County will provide the City with information about site services, hours and dates of <br />operation, and site rules, for use by the City in promoting the sites. <br />d. The County will work with the City to evaluate use of the yard waste sites by City residents <br />and determine whether to renew this agreement and, if to be renewed, the appropriate <br />terms and conditions for that renewal. <br />CITY OBLIGATIONS <br />a. Upon receipt of an invoice from the County, the City will pay the County $5,000 in order to <br />assure services for those City residents that do not reside in the County. <br />b. When it promotes use of the County yard waste sites, the City will provide information <br />consistent with information provided by the County. <br />c. The City will work with the County to evaluate use of the yard waste sites by City residents <br />and determine whether to renew this agreement and, if to be renewed, the appropriate <br />terms and conditions for that renewal. <br />2. TERM <br />The term of this agreement shall be from November 1, 2005, through December 31, 2006, the date <br />of signatures notwithstanding. <br />3. TERMINATION <br />a. FOR CAUSE: In the event that the City fails to comply with the terms of this Agreement, or <br />any statutory requirement, ordinances and/or plans related to this Agreement, the County <br />may terminate this Agreement.
