City Council Regular Meeting Minutes <br />November 8, 2005 <br />Page 4 <br />2 Mr. Pratt noted during conversations with potential customers, they indicated they did not care <br />3 for stairs; therefore, the patio homes are one -level homes with a town home lifestyle where items <br />4 such as the grounds are managed by the association. He showed style and floor plan examples. <br />5 <br />6 Mayor Faust asked if on the two properties that offers have been made, have there been certified <br />7 independent appraisals done. Mr. Pratt replied experts, including appraisers and owners of <br />8 typical properties, have been relied on, although no certified appraisal has been done. He added <br />9 offers have been presented and it is now up to the sellers to counter and if there is a difference <br />10 then certified appraisals can be added as a negotiation tool for the price. <br />11 <br />12 Mayor Faust suggested, because it is a legal document, on the development agreement, page 4, <br />13 item F, information needs to be added about certified appraisals before moving forward. Ms. <br />14 Kvilvang replied before a condemnation is brought to Council there would be an appraisal to <br />15 review the price. Mr. Gilligan replied there is additional language in the actual development' <br />16 agreement that states Council has a review of all documents including costs. He asked if the <br />17 appraisal be required for condemnation or for privately required parcels, too. Mayor Faust <br />18 replied just for eminent domain, to be used judicially. <br />19 <br />20 Councilmember Thuesen agreed it should be added to the agreement. <br />21 <br />22 Councilmember Stille stated he could go either way because appraisals will be done, but adding <br />23 the language memorializes it. <br />24 <br />-25 Motion by Councilmember Horst, seconded by Councilmember Gray, to adopt Resolution 05- <br />26 088, re: Phase 2 Silver Lake Village with the addition of certified appraisals. <br />27 <br />28 Motion carried unanimously® <br />29 <br />30 D. Consider Ordinance 05-013, re: park dedication fees. (third reading) <br />31 Mayor Faust reviewed the ordinance with the Council and indicated that this is the third reading <br />32 to amend park dedication fees, which allows the City to become more in line with the going rate. <br />33 <br />34 Motion by Councilmember Thuesen, seconded by Councilmember Gray, to adopt Ordinance 05- <br />35 013, re: park dedication fees. <br />36 <br />37 Motion carried unanimously. <br />38 <br />39 E. Consider Ordinance 05-014, re: wine and 3.2 malt liquor combination license. (third <br />40 reading) <br />41 Mr. Mornson reviewed the ordinance with the Council and indicated that this will allow <br />42 businesses with an on -sale wine license and an on -sale 3.2 malt liquor license to sell intoxicating <br />43 malt liquor without an additional license. There currently are two businesses in the City this <br />44 would apply to. He added businesses would need 60% in food sales, which is set by state statute. <br />45 <br />46 Motion by Councilmember Stille, seconded by Councilmember Horst, to adopt Ordinance 05- <br />47 014, re: wine and 3.2 malt liquor combination license. <br />51 <br />
