8.3. EMPLOYEES shall be recalled from layoff on the basis of seniority. The EMPLOYEE <br />laid off with the highest seniority shall be recalled first. An EMPLOYEE on layoff shall <br />have an opportunity to return to work before any new EMPLOYEE is hired. <br />8.4. Vacation requests shall be selected on the basis of seniority until March 15th of each <br />calendar year. <br />9. DISCIPLINE. <br />9.1. The EMPLOYER will discipline EMPLOYEES for just cause only. Discipline will be in <br />one or more of the following forms: <br />9.1.1. Oral reprimand; <br />9.1.2. Written reprimand; <br />9.1.3. Suspension; <br />9.1.4. Demotion; <br />9.1.5. Discharge. <br />9.2. Discipline that is placed in the EMPLOYEE'S personnel file shall be read and <br />acknowledged by signature of the EMPLOYEE. The UNION and the EMPLOYEE <br />involved will receive a copy of such discipline. <br />9.3 Discharges will be preceded by a five (5) day suspension without pay. <br />9.4. EMPLOYEES will not be questioned concerning an investigation of disciplinary action <br />unless the EMPLOYEE has been given an opportunity to have a UNION <br />representative present at such questioning. <br />9.5. Grievances relating to this Article shall be initiated by the UNION at the Step 3 level of <br />the Grievance Procedure of Article 6. <br />9.5.1 If, as a result of the written response to 6.1.3 Step 3, the grievance remains <br />unresolved and if the grievance.invoIves the suspension, demotion or <br />discharge of an EMPLOYEE who has completed the required probationary <br />period, the grievance may be appealed to Step 4 of Article 6 or a procedure <br />such as Veteran's Preference or Fair Employment. If appealed to any <br />procedure other than Step 4 of Article 6, the grievance is not subject to <br />arbitration as provided in Step 4 of Article 6 of this AGREEMENT. <br />9.6. EMPLOYEES may examine their own individual personnel files at reasonable times <br />under the direct supervision of the EMPLOYER. <br />10. WAGE SCHEDULE. <br />10.1. EMPLOYEES working out of classification will receive the hourly rate of that position. <br />When a FEO/Firefighter is working out of class, as shift officer on duty, they are paid <br />Captain Wages. <br />10.2. Hourly salary for Fire Marshall, Captain and Fire Fighter/FEO shall be as follows: <br />2006 2007 <br />FIRE MARSHALL/ASST. CHIEF $21.74 $22.50 <br />CAPTAIN $18.84 $19.50 <br />L: <br />
