CITY OF ST. ANTHONY VILLAGE <br />RESOLUTION 06-032 <br />A RESOLUTION FOR A COMMERCIAL PARKING REQUIREMENT VARIANCE <br />FOR THE PROPERTY LOCATED AT 3803 SILVER LAKE ROAD <br />WHEREAS, strict. application of the provisions of the City's zoning ordinance would <br />cause undue hardship because of the pre-existing storm water pond and <br />easement that was. required by the Rice Creek Watershed District for <br />redevelopment of the area to occur and that the storm water pond is <br />unique to the subject property; and <br />WHEREAS, that this hardship was not created by the applicant but rather by the <br />requirements of Rice Creek Watershed for the management of the City's <br />storm water; and <br />WHEREAS, that the granting of the variance would not alter the essential character of <br />the neighborhood because the use is compatible with the Commercial <br />Zoning District; and <br />WHEREAS, that without the variance, the property cannot be put to a reasonable use <br />because of the limited useable and buildable land. Other proposed uses <br />for the lot have included fast food restaurants and other shops which <br />would cause higher traffic volumes, accessibility issues for the lot and <br />further reduced parking options; and <br />WHEREAS, that economic hardship alone is not the sole purpose for the variance, <br />reducing the size of the building by 1015/o was not determined to be a <br />viable option because parking would continue to be limited due to the <br />stormwater pond. <br />NOW, THEREFORE BE IT RESOLVED, the Planning Commission recommended City <br />Council approve the commercial parking requirement variance for the property located <br />at 3803 Silver Lake Road. <br />Adopted this 28th day of March, 2006, <br />ATTEST: <br />City Clerk <br />Review for Administration: <br />Mayor <br />City Manager <br />15 <br />
