CITY OF ST. ANTHONY VILLAGE
RESOLUTION 06-032
A RESOLUTION FOR A COMMERCIAL PARKING REQUIREMENT VARIANCE
FOR THE PROPERTY LOCATED AT 3803 SILVER LAKE ROAD
WHEREAS, strict. application of the provisions of the City's zoning ordinance would
cause undue hardship because of the pre-existing storm water pond and
easement that was. required by the Rice Creek Watershed District for
redevelopment of the area to occur and that the storm water pond is
unique to the subject property; and
WHEREAS, that this hardship was not created by the applicant but rather by the
requirements of Rice Creek Watershed for the management of the City's
storm water; and
WHEREAS, that the granting of the variance would not alter the essential character of
the neighborhood because the use is compatible with the Commercial
Zoning District; and
WHEREAS, that without the variance, the property cannot be put to a reasonable use
because of the limited useable and buildable land. Other proposed uses
for the lot have included fast food restaurants and other shops which
would cause higher traffic volumes, accessibility issues for the lot and
further reduced parking options; and
WHEREAS, that economic hardship alone is not the sole purpose for the variance,
reducing the size of the building by 1015/o was not determined to be a
viable option because parking would continue to be limited due to the
stormwater pond.
NOW, THEREFORE BE IT RESOLVED, the Planning Commission recommended City
Council approve the commercial parking requirement variance for the property located
at 3803 Silver Lake Road.
Adopted this 28th day of March, 2006,
ATTEST:
City Clerk
Review for Administration:
Mayor
City Manager
15
