By way of background, the developer, Amcon St. Anthony, LLC, turned the building over to the operator, St. Anthony Restaurant Group, Inc., on or about February 1, 2006. Application was made by the operator to the Health Department on February 10, 2006. The operator did not receive any written communication until March 5, 2006 at which time they received from the Minnesota Health Department a Notice of No Approval and some minor changes that had to be made to the plans. The application was re -submitted and finally approved on March 23. 2006. The applicant was also required to make an application with the State Licensing Department for plumbing and electrical. A plumber was hired and application was made on March 16, 2006 with the State of Minnesota. The applicant paid a double fee which was necessary to expedite the application within a seven day period. The check was not cashed by the State of Minnesota until March 25, 2006. The applicant continued to have numerous problems with the State Plumbing Licensing Department. The Department explained that they had 3,600 applicants this spring. The Licensing Department lost the plans two times and they had to be submitted on two separate occasions.
