especially true on the west side of the lot where it is adjacent to County Road <br />C/29thAvenue. The west side is also considered the front yard, requiring a large <br />set back. In addition to being bordered by three streets, the building occupies <br />more than 50 % of the lot. This situation further limits the amount of space <br />available for parking. The Planning Commission found this property is *unique <br />as it is bordered on three sides by streets, which according to the City Ordinance <br />requires additional setback distances. Anthony Lane South on the west side of <br />the property is found to be a wider street and as such would not be impacted by <br />allowing the parking lot to encroach into the setback by nine feet; and <br />WHEREAS, The granting of the variance is in keeping with the spirit and intent of the Zoning <br />Code. The Zoning Code requires 38 parking spaces for the Building Fastener <br />building based on square footage and largest shift. Granting a parking variance <br />for the additional 11 spaces would be in keeping with the spirit and. intent of the <br />Zoning Code. The Planning Commission found that by allowingtheparking <br />p g <br />variance, the impact on the surrounding properties and vehicular traffic would <br />be reduced. Cars would not be parked on the street creating difficult passage for <br />traffic in the area and Mr. O'Brien would not have to depend on neighboring <br />properties to provide overflow parking for his employees and customers; and <br />WHEREAS, The Planning Commission stipulated that if this request is approved and if any <br />trees are removed for the construction of this parking area, he needs work to <br />with City Staff to replace there. <br />NOW, THEREFORE BE IT RESOLVED, the Planning Commission recommends to the City <br />Council approve a variance for parking expansion at 2825/2827 Anthony Lane South. <br />Adopted this 25th day of Jq1y, 2006. <br />ATTEST: <br />City Clerk <br />Review for Administration: <br />Mayor <br />City Manager <br />F:\Planning\Resolutions\Building Fasteners Parking Variance Resolution2006.doc <br />43 <br />
