REPORTS FROM COMMISSION AND STAFF. <br />A. Ordinance 07-004 Text Amendment to Light Industrial Section 1640.02. <br />Planning Commissioner Jensen reported that if the proposed text amendment were approved, it <br />would allow daycare centers to be permitted conditional use in the Industrial Zoning District and <br />would require an approved CUP. <br />Councilmember IIorst questioned whether this came before the Planning Commission as a <br />variance request first. <br />Commissioner Jensen replied it came forward as a text amendment with different alternatives. <br />He stated the City Attorney provided a revised draft version for consideration. <br />Councilmember Horst questioned what other uses might be similar. <br />Commissioner Jensen replied certain categories of retail, office as a permitted use. IIe stated <br />most of the buildings in this area are office related uses. <br />Councilmember Horst inquired as to whether the question was asked about usage that would <br />emit a smell that might affect the children. <br />Commissioner Jensen Planning Commission felt that was not a specific issue as it related to the <br />text amendment because the conditional use permit criteria, should it be approved, would be the <br />time to evaluate whether it was an appropriate blend of the use. He stated most of the criteria <br />dealt with other environmental controls and moved away from that type of building. <br />Mr. Robert Foster, 3308 Beldon Drive, stated he brought the text amendment forward. He <br />reported Mrs. Carol Arens, owner of the daycare, and Mr. Rod Lee would be part owners of the <br />building. He stated they looked at the character of the building would changed to predominantly <br />an office building site. He reported that approximately 20,000 square feet of the building would <br />not have an industrial character. He stated it is their desire over the next five years, to see if the <br />rest of the building could be converted to an office area also. He commented that Mrs. Arens <br />opened a second school in Blaine last week that is the prototype of the proposed building in St. <br />Anthony. <br />Motion by Councilmember Thuesen, seconded by Councilmember Gray, to approve Ordinance <br />07-004, an Ordinance Amending Chapter 16 of the City Code being Zoning and Land Use. <br />Mayor Faust stated this is the first reading of this issue and two additional readings would occur. <br />Councilmember Horst commented the primary problem created by the tenants was its proximity <br />to a daycare. He commented that he wonders if Council would be looking at problems down the <br />road as light industrial is technically retail. He stated there is a reason a daycare is currently not <br />located in light industrial. <br />17 <br />
