City Council Regular Meeting Minutes <br />June 10, 2008 <br />Page 4 <br />City Engineer Hubmer replied there will likely be a large number of bids submitted due to the <br />current conditions in the housing industry and the little work that is available for contractors. <br />Motion by Councilmember Roth, seconded by Councilmember Stille, to adopt Resolution 08- <br />041, Ordering Feasibility Report for the 2009 Street Reconstruction Project. <br />8 Motion carried unanimously. <br />9 <br />10 City Engineer Hubmer provided an overview of the Silver Lake Road Project. He stated staff is <br />11 staying in touch with Hennepin County and coordinating efforts. The project is moving along <br />12 very well. <br />13 <br />14 Councilmember Roth inquired about the status of the 2007 Street Reconstruction Project. <br />15 <br />16 City Engineer Hubner stated punch list items are being completed on the 2007 Street <br />17 Reconstruction Project. The project should be complete in the next few weeks. <br />18 <br />19 C. Consider Ordinance 08-006; Amending Section 580 Fireworks Dealers. <br />20 <br />21 City Manager Morrison reviewed the ordinance with the Council and indicated that staff has <br />22 noticed that the current City ordinance restricts the total quantity of consumer fireworks stored <br />23 on any property from exceeding 100 pounds. Minnesota Statute 624.20 states "A local unit of <br />24 government may not..., prohibit or restrict the display of items for permanent or temporary retail <br />25 sale authorized under paragraph (c) that comply with National Fire Protection Association <br />26 Standard 1124." He stated there is not a weight limit in Standard 1124. City Manager Morrison <br />27 explained the weight limit was likely included in the City ordinance in order to limit gas stations <br />28 or smaller commercial stores from putting up tents for the sale of fireworks. However, Wal-Mart <br />29 and Cub are the only businesses that applied for a permit in 2007, and at this point are the only <br />30 two that have applied for a 2008 permit. City Manager Morrison stated staff recommends <br />31 waiving the first and second reading of the ordinance and adopting the proposed ordinance <br />32 tonight. <br />33 <br />34 Councilmember Stille verified with City Manager Morrison that the current ordinance cannot be <br />35 enforced according to State Statute. <br />36 <br />37 Motion by Councilmember Stille, seconded by Councilmember Roth, to waive the First Reading <br />38 and Second Reading, approve the Third Reading, and adopt Ordinance 08-006; Amending <br />39 Section 580 Fireworks Dealers. <br />40 <br />41 Motion carried unanimously. <br />42 <br />43 VII. REPORTS FROM CITY MANAGER AND COUNCII. MEMBERS. <br />44 <br />45 Councilmember Stille thanked staff for their work in hosting the visitors from the Sister City of <br />46 Salo, Finland last week.
