STAFF REPORT <br />To: City Council <br />City Manager <br />- - - 20 <br />Froth: Kim Moore -Sykes, Assistant City Manager <br />Date: July 22, 2008 <br />Subject: 2526 U.S. Highway 88, Northgate Business Center; Twin Cities Christian Assembly (TCCA) <br />Requested Action: Conditional Use Permit <br />Date Application Received: June 19, 2008 <br />Property Address: 2526 U.S. Highway 88, Northgate Business Center <br />Zoning District: C <br />60 -Day Expires: August 20, 2008 <br />Waiver Letter Required: Yes Date Sent: No Y <br />Future Action: Council Action: Approval or Denial of Conditional Use Permit <br />Background: Mr. Julius Chu, Twin Cities Christian Assembly (;-'CCA), contacted Staff when he was advised by <br />the Fire Department that he needed to contact the City Staff before they would sign off on Mr. Chu's request for <br />an occupancy permit. He was told that die TCCA may not be in compliance with the City's Zoning Ordinance <br />as it is not a use listed as a permitted use in the commercial zoning district. <br />Upon contacting City Staff, Mr. Chu was advised that locating TCCA in the Northgate Business Center requires <br />a conditional permitted use (1635.03 (c) ). Mr. Chu was also informed about the application and public hearing <br />processes. He attended a concept review at the June 17'h Planning Commission meeting to present information <br />on the Twits Cities Christian Assembly organization and to discuss the need for a conditional use permit. <br />Application Review and Analysis: Minnesota Statutes and City Ordinances require that various criteria be met <br />by the applicant for an application for a conditional use permit can be considered. <br />1. The requested conditional use is one of the Permitted Conditional Uses specifically listed for <br />the zoning district in which the conditional use is located. City Code, Chapter 16 at 1635.03 (c), <br />that lists assembly, lodge or convention halls as permitted conditional uses in the Commercial zoning <br />district. <br />2. That the requested conditional use permit will not be detrimental to health, safety or general <br />welfare of persons residing or working in the vicinity or injurious to property values of <br />improvements in the area. TCCA, as reported by Mr. Chu is a non-profit organization and often <br />provides resources and information on community services. Mr. Chu also reported that TCCA has <br />been located at the subject property since July 2006.
