1.2 <br />STAFF REPORT <br />DATE: August 8, 2008 <br />TO: Council Members <br />Jerry Faust, Mayor <br />Mike Morrison, City Manager <br />FROM: John Ohl, Chief of Police <br />SUBJECT: Dangerous Dog Dearing <br />Backgr2und• <br />On 05-18-07, a Schwan's truck driver (Justin Oldre) reported being bitten by Gordon Blackey's <br />dog, "Guido." Mr. Oldre reported that he knows both Gordon Blackey and the dog. He <br />indicated that he was bitten just below the right rear buttocks, and the bite left two 3 inch cuts <br />on his leg as well as ripping his pants. Mr. Oldre reported that he was bitten by the dog when he <br />entered the yard to make a delivery at 3020 Croft Drive. This report was phoned into the police <br />department and the bite was not documented by police photographs. <br />On 11-16-07, an individual by the name of Rodney Towle reported that he had been bitten by a <br />black dog residing at 3020 Croft Drive. Mr. Towle indicated that he was delivering something <br />to 3012 Croft (next door neighbor), at which time he was approached by and bitten in the back <br />of his left leg. This report was phoned into the police department and was not documented by <br />police photographs. <br />On 06-26-08, an individual by the name of Nicholas Mcelhose reported being bitten by a black <br />dog that resides at 3020 Croft Drive. Mx. Mcelhose was putting up flyers in the neighborhood <br />for a window and siding company called "Maintenance Free MN, Inc." Mr. Mcelhose was <br />accompanied by an individual identified as David Ralls, who indicated that he works with two <br />different schools providing work for mentally challenged young adults. This report was <br />documented with police photographs. <br />Law Analysis: <br />MN State Statute 347.50 defines dogs in one of two ways: potentially dangerous and <br />dangerous. <br />A "potentially dangerous" dog means any dog that: <br />1 • When unprovoked inflicts a bite on a human or domestic animal on public or <br />private property, <br />
