24 <br />On 11/16/07, 1 met with the SAPD regarding a reported dog bite. I complied with the <br />SAPD b}, quarantining the dog, producing the St. Anthony dog license, and paperwork <br />showing all current vaccinations. <br />RP/Towle stated he was bit at approximately 10:30 AM on 11/16/07, but called the police <br />at 12:10 PM to make a report of a dog bite over the phone. I spoke with illy neighbor <br />Merril, who stated RP/Towle called her and told her that her dog was out. Merril stated it <br />was not her dog. RP/Towle called back to Merril and stated to her the dog had bitten <br />him. I spoke to RP/Towle, who told me he was bit by my dog. I asked RP/Towte if we <br />could meet so I could see the injury, and lie stated no, he was fine. <br />RP/Towle called me two weeks later stating he wanted my homeowners insurance <br />information. RP/"Towle stated lie could file a claim with my insurance and it would not <br />hurt my insurance or the status of the dog. RP/Towle stated this happened to his brother <br />and he collected money from the insurance company. I infomcd RP/Towle without <br />proof of an injury I was not wilting to give out this information. RP/Towle stated lie <br />needed fifteen hundred dollars from me for an MRI because his back was now hurting <br />and he could not. walk, at which point I told him no. <br />An attorney contacted me in a letter stating he wanted my insuance information or I <br />would be sued. 1 replied to the Attorney in the letter, stating I needed proof of this injury, <br />at which point they did not pursue it any further. <br />Regarding the police report taken on 06/2.6/08, St. Anthony City Ordinance Section 1130 <br />states that peddlers and solicitors must obtain a license from dile city. Registration and its <br />conditions are required by the City of St. Anthony. Violation of this Ordinance is <br />considered trespassing. <br />Mr. Mcelhose and Mr. Ralls are in violation of our City's Ordinance that requires <br />solicitors and peddlers to obtain a license. Due to this fact, Mr. Mcelhose was in fact in <br />violation of a City Ordinance and in fact illegally on my property. <br />It should also be noted that I did speak to both Mr. Mcelhose and Mr. Ralls down the <br />street from my hone. Mr. Ralls told me he told Mr. Mcelhose not to go into the yard <br />because there was a dog there. Mr. Ralls stated he was sorry, he should have stayed with <br />Mr. Mcelhose. <br />Mr. Mcelhose stated to me he went into the yard, saw the dog, and ran. Mr. Mcelhose <br />stated he tripped and fell to the ground, and as the dog came up to him he tried to kick to <br />keep the dog away, and that is when the dog bit him. <br />The State definition for Provocation is an act that an adult could reasonably expect may <br />cause a dog to attack or bite. It is reasonable to expect a dog may bite someone on his <br />own property if in fact he is being kicked. <br />
