City Council Regular Meeting Minutes <br />September 23, 2008 <br />Page 3 <br />1 Councilmember Roth verified with Commissioner Chaput that the Hayes residence currently has <br />2 access to the Lake through the casement. <br />4 Mayor Faust explained that the access would be available to individuals with casement rights <br />5 included in their deed. <br />7 Councilmember Roth commented that the proposed layout with the subdivision appears to be an <br />8 odd design for a lot. He inquired about possible issues with future property owners. <br />9 Commissioner Chaput stated there was discussion about natural elevations leading to the way the <br />10 property lines were drawn, as well as the discussion of Mr. Hayes desiring additional lakcfront <br />11 access that follows the existing easement. <br />12 <br />13 Councilmember Stille stated lie feels comfortable that there was good representation at the <br />14 Planning Commission level. He pointed out that one of the Planning Commission members is a <br />15 planner that would have picked up on anything abnormal in the proposed lot subdivision. <br />16 <br />17 Dr. Gary Good, 4024 Silver hake Terrace, stated that the IIayes' lot does not have much of a <br />18 back yard with the way the house was put on the lot. If there is concern that the lot appears odd <br />19 as proposed, it was more so with just the easement and a tiny strip going to the lake. This <br />20 subdivision will widen the Hayes' shoreline to 16 feet, rather thanjust 10. It will also correct a <br />21 problem caused when he was not sure of the boundary line and paved about 7 feet on Mr. Hayes' <br />22 property. <br />23 <br />24 Mr. 'Hayes, 4020 Silver Lake Terrace, stated there has been plenty of speculation and rumors <br />25 about the easement. He spoke with the Ramsey County Assessor in 2002 who informed him that <br />26 the easement is deeded to he and his wife, and that two neighboring properties have access to the <br />27 easement. He does not believe it is a public easement, as it is deeded in he and his wife's names. <br />28 He pointed out that the casement is not part of this transaction. As far as the layout, it is <br />29 lakeshore and there are crazy designs with lakeshore property. <br />30 <br />31 Motion by Councilmember Roth, seconded by Councilmember Gray, to adopt Resolution 08- <br />32 061; Approval of a Lot Subdivision of 3,062 square feet for 4024 Silver Lake Terrace. <br />33 <br />34 Motion carried unanimously. <br />35 <br />36 B. Resolution 08-062; Approval of a Lot Subdivision of 337 square feet for 4020 Silver <br />37 Lake Terrace. <br />38 <br />39 Motion by Councilmember Stille, seconded by Councilmember Gray, to adopt Resolution 08- <br />40 062; Approval of a Lot Subdivision of 337 square feet for 4020 Silver Lake Terrace. <br />41 <br />42 Motion carried unanimously. <br />43 <br />44 VI.
