Consider Resolution 08-079; Requesting a Variance to Horizontal Alignment <br />Requirement Set Forth by State Aid Operations for the 2009 Street and Utility <br />Improvement Project. <br />Todd Ilubmer, WBS & Associates, provided a report that included two curves on the 2009 Street <br />Improvement project. He stated staff is requesting a resolution from the City Council to accept <br />the Resolution as proposed. <br />10 Councilmember Stille asked if they needed a Public Hearing. <br />11 <br />12 City Attorney Lindgren stated the City is requesting a variance, not granting one. <br />13 <br />14 Mayor Faust asked what is the benefit of the City to make it a 25 MPH road. <br />15 <br />16 Mr. Hubmer explained the State actually requires this road to be 30 MPH so in order to receive <br />17 money from MnDOT they have to design it in accordance with their standards. Therefore, 25 <br />18 MPH is the closest they can get to their standards. <br />19 <br />20 Mayor Faust asked if they may not get the money if they do not change the speed limit. <br />21 <br />22 Mr. Hubmer stated this is similar to the 29°i Avenue project where they do the project and then <br />23 get reimbursed by the State. <br />24 <br />25 Councilmember Thuesen asked whether the curve would be a little gentler for a safety <br />26 improvement. Mr. Hubmer stated they are improving the curve to make it safer. <br />27 <br />28 Motion by Councilmember Gray, seconded by Councilmember Roth, to adopt Resolution 08- <br />29 079; Requesting a Variance to Horizontal Alignment Requirement Set Forth by State Aid <br />30 Operations for the 2009 Street and Utility Improvement Project. <br />31 <br />32 Motion carried unanimously. <br />33 <br />34 C. Consider Resolution 08-080; Fannie Mae. <br />35 <br />36 Stacie Kvilvang, Ehlers & Associates, provided a report on the resolution requesting an <br />37 extension of a loan with Fannie Mae. She stated staff is recommending approval. <br />38 <br />39 Councilmember Stille asked where the development contract would be at if the City made the <br />40 $75,000 payment. <br />41 <br />42 Jay Lindgren, Dorsey & Whitney, explained how the resolution will work in regard to an <br />43 agreement with Fannie Mae and the developer, and how the payments will be made. <br />44 <br />
