City Council Regular Meeting Minutes <br />June 23, 2009 <br />Page 4 <br />Mayor Faust noted the consensus of the Council to direct staff to proceed with greater <br />enforcement of the current parking regulations. <br />Ayes — 3, Nays — 2 (Stille and Thuesen). Motion carried. <br />D. Consider Ordinance 2009-006; Amending Current Code to Allow Background Checks. <br />Mike Morrison, City Manager, presenting (1St reading). <br />9 City Manager Mornson reviewed the ordinance with the Council and indicated that as part of the <br />10 recodification of the City Code, the attorneys assisting staff with the process advised that it was <br />11 not necessary to codify the City's Personnel Policy as most of the regulations and laws were <br />12 originated and supported by State or Federal statutes and legislation, and that no need existed to <br />13 codify them as part of the City's Code. However, because the City's authority to request <br />14 background checks of prospective new hires and liquor license holders existed as a part of the <br />15 codified City's Personnel Policy, it was inadvertently removed when the City's recodified Code <br />16 of Ordinances was approved and adopted by the City Council. Staff is requesting that this <br />17 language be returned to the City's Code of Ordinances so that the Police Department may be <br />18 again authorized to conduct Bureau of Criminal Apprehension (BCA) criminal background <br />19 checks on prospective new hires and licenses. <br />20 <br />21 Councilmember Roth requested staff to look into how many years into the past the background <br />22 checks go. He noted there was an incident in the news where a gentleman became an apartment <br />23 complex manager, and the background check did not uncover information about his past 14 years <br />24 ago because the check only went back 10 years. He asked if employees have been hired recently <br />25 without background checks being done as a result of the City not having the necessary authority. <br />26 City Manager Morrison replied that due to the hiring freeze, the only hiring being done at this <br />27 time is part-time liquor employees. There have not been any employees hired until this is taken <br />28 care of. Liquor licenses have been approved, as the City has the ability to do a partial <br />29 background check. The biggest concern is to have background checks done on solicitors going <br />30 door to door. <br />31 <br />32 Motion by Councilmember Gray, seconded by Councilmember Roth, to approve the First <br />33 Reading, Waive the Second and Third Readings, and adopt Ordinance 2009-006; Amending <br />34 Current Code to Allow Background Checks. <br />35 <br />36 Motion carried unanimously. <br />37 <br />38 VII. REPORTS FROM CITY MANAGER AND COUNCIL MEMBERS. <br />39 <br />40 City Manager Mornson reported on the following: <br />41 • There are no agenda items scheduled for the July 14, 2009 City Council meeting. The <br />42 third reading of Ordinance 2009-005 could be scheduled for the July 18, 2009 City <br />43 Council meeting if the Council chooses. <br />44 • June 16, 2009— Roseville meeting to discuss Higherest Overlay Project <br />45 • June 17, 2009 — New Brighton meeting to discuss sharing of resources equipment, <br />46 purchasing, and employee training. <br />11 <br />
