-- P. 2 STAFF REPORT To: Mayor, City Council Milne Morrison, Qty Manager From: Kim Moore -Sykes, Assistant City Manager Date: March 24, 2009 Subject: 3055 Old US Highway 8 Administrative Lot Split Requested Action: Consider Lot Split Request Date Application Received: Dec. 23, 2008 Propeity Address: 3055 Old US Highway 8 Zoning District: LI 60 -Day Expires: April 22, 2009 with Extension to April 28, 2009 Waiver Letter Required: Yes X Date Sent: 1/21/09 No Future Action: City Council Action; March 24, 2009 Background: Mr. David Lutz, General Counsel for The Wirth Companies submitted an application and fees for an Administrative Lot Split without flatting on December 23, 2008. Mr. Lutz met with Staff regarding their proposal to split the property located at 3055 Old Highway 8. Mr. Lutz reported that his client is proposing to split this property into two parcels in order to facilitate the future and eventual redevelopment of that parcel currently comprising the parking lot. The City attorney reviewed the proposed preliminary plat and advised Staff that he would not recommend approval for this plat as configured and proposed. When Staff advised Mr. Lutz of the situation, Mr. Lutz requested that the Planning Commission table the public hearing until February 17, 2009. Mr. Lutz was also asked to present a parking analysis for Lot B for the rescheduled public hearing. Staff estimates that Lot B has between 35 - 40 parking spaces and that the parking needs for this building is approximately 65 - 70 spaces total. Mr. Lutz did not attend the rescheduled February 17th public hearing with the Planning Commission and had not provided Staff with a parking analysis until February 18, 2009, the day after the public hearing. The revised site plan that includes the parking analysis was forwarded to the City Attorney for review ahead of the City Council meeting scheduled for February 24, 2009. Mr. Lutz submitted a parking plan that proposes 92 parking spaces with one space designated as handicapped parking. Claiming misunderstanding of the date and time of the City Council meeting, Mr. Lutz did not appear at the February 24th City Council meeting. The City Council remanded this item back to the Planning Commission for a public hearing scheduled for March 17, 2009, The City is still in conformance with the 120 -day rule for Subdivision.
