City Council Regular Meeting Minutes <br />January 24, 2012 <br />Page 5 <br />2 Mayor Faust acknowledged the City Council's concerns regarding the City's cost for the Lowry <br />3 Avenue drainage improvements but reminded the City Council that MWMO will be providing <br />4 the City with over $1 million for in-line treatment. He felt it was important to remain cognizant <br />5 of this and stated the proposed improvements are probably the best solution. <br />6 <br />7 Motion by Councilmember Roth, seconded by Councilmember Jenson, to approve Resolution <br />8 12-017; Calling a Hearing for the 2012 Street and Utility Improvements. <br />10 Motion carried unanimously. <br />11 <br />12 I3. Ordinance 2012-01 • Relating to Regulation of Tobacco Sales Amending Section 111.057 <br />31 of the St. Anthony City Code (I" Reading) Mark Casey City Manager ro esenting. <br />32 <br />33 City Manager Casey presented the proposed revisions to the City's tobacco ordinance and stated <br />34 the current ordinance does not include a provision to hold an owner responsible which means the <br />35 City cannot cite the owner if smoking occurs on the premises. <br />36 <br />37 Mayor Faust asked if the City has notified all tobacco license holders. <br />38 <br />39 City Manager Casey replied that thirty day notice of the proposed revisions was provided to all <br />40 tobacco license holders. <br />41 <br />42 Motion by Councilmember Stille, seconded by Councilmember Jenson, to waive the first and <br />43 second readings of Ordinance 2012-01; Relating to Regulation of Tobacco Sales, Amending <br />44 Section 111.057 of the St. Anthony City Code. <br />45 <br />46 Motion carried unanimously. <br />5 <br />
