53 <br />as approved by the City Planning Commission on November 15, 2011, as updated on <br />January 4, 2012 (the "Final Development Plan"). <br />2. Planned Unit Development Approval. <br />The City hereby grants approval of the Final Development Plan subject to the <br />approval of the final plat and the Developer's compliance with the terms and conditions <br />of this Development Agreement. The City agrees to approve the final plat and <br />applications for building permits, provided that said plat and plans are consistent with the <br />exhibits which were approved at the Concept level of the Planned Unit Development <br />process, and that all of the conditions of this Development Agreement have been <br />satisfied. <br />3. Approval by Saint Anthony Village. <br />The Developer shall develop the Property in accordance with the Final <br />Development Plan. If, however, any plans or exhibits vary from the written terms of this <br />Development Agreement, the written terms shall control. The City hereby approves the <br />Development subject to the following terms and conditions: <br />A. That the proposed site for the Project was formally added to the <br />Developer's existing PUD in 2003; <br />B. That the Final Development Plan does not exceed the maximum density <br />range and is an appropriate plan for the R-4 Residential Zoning District; <br />C. That the general location of major streets and pedestrian ways are shown <br />on the Final Development Plan; <br />D. That the Final Development Plan shows the general location and extent of <br />public and common open spaces; <br />E. That the Final Development Plan shows the general location of residential <br />and non-residential land uses with the appropriate type of intensities of <br />development; <br />F. That the Developer has provided adequate information regarding the <br />staging and time schedule of development; <br />G. That the Final Development Plan includes other special criteria and design <br />details for the development of the proposed assisted living facility <br />including parking, landscaping, and signage within the R-4 Residential <br />Zoning District; <br />H. That the north arrows on the architectural drawings submitted with the <br />Final Development Plan be corrected, as requested at the November 15, <br />2011 Planning Commission Meeting; <br />I. That the Developer has provided the City with comments from the <br />Developer's engineers, Hennepin County, and the Watershed District, as <br />requested at the November 15, 2011 Planning Commission Meeting; and <br />J. That the Developer has provided the City with copies of environmental <br />assessment documents created for construction as well as any soil reports, <br />as requested at the November 15, 2011 Planning Commission Meeting. <br />
