54 <br />4. Timeframe for Develonment <br />The Project will be completed by December 31, 2014, unless otherwise extended <br />by the City Council. <br />5. Comnlianee with Laws and Reeulations <br />The Developer represents to the City that the development and operation of the <br />proposed Project complies with all City, County, Metropolitan, State, and Federal laws <br />and regulations, including but not limited to: Subdivision Ordinances, Zoning <br />Ordinances and Environmental Regulations. The Developer agrees to comply with such <br />laws and regulations. <br />Specific Use. <br />'rhe City, within Ordinance No. 2012-02, has amended its Code to allow for the <br />specific use on the Property of an assisted living facility consisting of 72 assisted living <br />units and up to four stories. Parking for the facility will consist of 18 underground stalls <br />for residential and staff parking, 13 parking spaces on the northeast end of the facility on <br />Kenzie Terrace, and 13 parking spaces on the southwest end of the facility. Landscaping <br />on the lot will consist of a variety of perennial and shrub planting, as well as deciduous <br />and coniferous tree planting to create a residential feel and natural barriers from adjacent <br />buildings and homes. The lot will include a monument sign at the entrance to the new <br />facility that is exactly eight feet tall with the double -sided sign total of 47.4 square feet. <br />The City agrees to allow for this specific use on the Property, subject to the <br />Developer's strict compliance with the approved plans, and the terms and conditions of <br />this Development Agreement. Minor variations from the approved plans may be <br />approved by the City, under the direction of the City Manager. <br />Substantial departures from the approved plans will require an amendment to the <br />Planned Unit Development, in accordance with section 152.206 of the City of St. <br />Anthony Village Zoning Ordinance. Failure by the Developer to commence development <br />activity, in accordance with the Final Development Plan, within one year following the <br />final approval of this Planned Unit Development, will necessitate the approval of an <br />extension of the development schedule by the City Council. <br />Extension of Restrictive Covenants. <br />A. The covenants and restrictions recorded against Lot 1, Block 1 ST. <br />ANTHONY LANEL ADDITION in the document entitled Declaration of <br />Restrictive Covenants and Land Use Restriction Agreement, dated July 1, <br />1992 and recorded August 6, 1992 as Doc. No. 5952082, amended by First <br />Amendment to Declaration of Restrictive Covenants and Land Use <br />Restriction Agreement dated May 1, 2002 and recorded June 4, 2002 as <br />CR Doc. No. 7741403 ("the Declaration") shall be extended for an <br />additional period of time by entering into a Certification of Amendment of <br />Covenants in substantially the same form as attached hereto as Exhibit D <br />
