"Final Payment Date" means February 1, 2031. <br />"Final Plans" means the Final Plat and the other plans and specifications the City <br />approves pursuant to this Agreement, the PUD Agreement and the Minimum Improvements to be <br />constructed therein, as the same may be amended from time to time. Final Plans must address <br />the following, to the extent applicable: <br />(i) grading; <br />(ii) wetlands; <br />(iii) surface water quality; <br />(iv) storm water controls, erosion controls and drainage; <br />(v) street and lot layout; <br />(vi) utilities; <br />(vii) landscaping; <br />(viii) basement elevations; <br />(ix) signage; <br />(x) easements for public utilities; <br />(xi) parking; and <br />(xii) building location and exterior building design and appearance. <br />"Final Plat" means the final plat or replat for the Development when approved by the <br />City and the County. <br />"Financing Commitment" means a commitment from a Mortgage lender. <br />"Market Value" means the market value of real property as determined by the assessor <br />of the City in accordance with Minnesota Statutes, Section 273.11 (or as finally adjusted by any <br />assessor, board of equalization, commissioner of revenue or any court). <br />"Memorandum of Agreement" means the document described in Section 14.14 and <br />substantially in the form shown on Exhibit I. <br />"Minimum Improvements" means approximately 152 senior rental housing units, <br />together with related parking facilities, to be constructed by the Developer on the Development <br />Property, as depicted and described on the Design Drawings, attached as Exhibit B. The <br />Minimum Improvements will be further defined and must be constructed in accordance with the <br />Final Plans. <br />
