City Code § 152.140. <br />Section 151.141 of the Zoning Code lists nine types of permitted uses, which include <br />many specific examples of uses devoted to light industry. Examples include manufacturing <br />industries; warehouses, wholesalers, or distributors of products; and offices devoted specifically <br />for administrative purposes, non -retail businesses, or certain types of contractors. Other <br />permitted uses include automotive service and repair and cleaning, laundering, and dry cleaning <br />facilities. <br />Section 152.142 of the Zoning Code lists nine types of permitted conditional uses, which <br />also are uses exemplifying or directly supporting light industry. Examples include drug, <br />cosmetic, pharmaceutical, and toiletries manufacture; enameling, painting, varnishing, <br />lacquering, and japanning; freight terminals; and meat packing that does not include animal <br />slaughtering. <br />Overall, the light industrial zoning district occupies a small portion of the City. Little <br />available space for light industrial use exists because of the limited amount of railways and high <br />capacity roadways. Areas of the City zoned "light industrial" primarily exist within two specific <br />areas: 1) along or near the Soo Line railroad in the northern part of the City and 2) north of the <br />Northern Pacific Railway in the southeast part of the City, including areas along U.S. Highway <br />88 and County Road C. <br />3.5 Interpretation of Zoning Code Language Pertainin, to "Churches" or "Assemblies" <br />The Zoning Code does not define churches, temples or synagogues, nor does it define <br />assembly, meeting lodge, or convention halls. The Zoning Code specifically allows for <br />churches, temples, or synagogues within certain residential zoning districts. The Zoning Code <br />specifically allows for assemblies, meeting lodges, or convention halls within the commercial <br />and light industrial zoning districts. This Study finds that a difference exists between the City's <br />intended meaning of "churches, temples or synagogues" and "assemblies, lodges, or convention <br />halls." <br />A reasonable interpretation of `churches, temples or synagogues" is that this term <br />suggests a place of worship (or "religious" assembly) generally. This language does not exclude <br />any specific religion; denomination; or religious, spiritual, or philosophical viewpoint. Instead, <br />this provision is inclusive of diverse types of worship and allows for such uses within the <br />residential districts of the City. <br />A reasonable interpretation of "assemblies, meeting lodges, or convention halls" is that <br />this term suggests a place of secular assembly with a commercial or industrial purpose. <br />Examples might include certain membership organizations affiliated with business or industry <br />located within the commercial or light industrial zoning districts of the City. This language does <br />not exclude any type of secular assembly.
