MINUTES OF SPECIAL COUNCIL MEETING <br />FALCOTd HEIGHTS, MINNESOTA <br />JIJI~JE 3, 1971w. <br />A special meeting of the Falcon Heights City Council was called to order by Nlayor <br />ylarkentien at 8:10 P.I~?. <br />Mayor Warkentien, Councilmen B1ac?c, Ecklund, and Steele, PRE:~ENT <br />Also present were Clerk-Administrator Barnes and Attorney <br />Kenefick. <br />None. <br />Mr, and T?rs. Fred Gardner, 1880 Holton Avenue, were present <br />to discuss possible Council action on the driveway at the <br />residence of LeRoy Williams, 1886 Holton Avenue, which was <br />widened an additional eighteen inches to the property <br />line of the Gardners. The main concern is the snoVr that <br />is Wiled near their home at 1880 Holton in the winter by <br />the Williams', obstructing the basement t~rindows and <br />which causes a water problem in the spring. Mrs. Gardner <br />stated that she had contacted the City Ha11 regarding <br />this problem and was told that Mrs. Williams had. been <br />informed by the Building Inspector that in order to do <br />this they would have to obtain a variance, as the City <br />Ordinance requires driveways to be five feet from the <br />property line, a.nd a1 so obtain a building permit, <br />neither of which was procurred. <br />The Gardner's request was that the driveway be cut back <br />to two feet from the property line, and also cut it dot,m <br />in height, as it was raised approximately three inches <br />during the resurfacing. It was the Attorney's opinion <br />that the Council could enforce the Ordinance and have <br />the drive cut back to eighteen inches, but that there <br />is no provision stating that a property otmer cannot <br />increase the height of the drive, unless the natural <br />drainage or the level at which the drive meets the <br />street Vras changed. <br />AB 5'ENT <br />4 '7 I~ <br />DRIVEGJAY AT 1886 HOLTON <br />Councilman B1a.ck moved, seconded by Councilman Ecklund, <br />that the Attorney be instructed to ?~rrite to the Williams, <br />at 1886 Holton Avenue, explaining that they are in violation <br />of the ordinance, requesting that they obtain a building <br />permit, a double fee will be charged, and also that the <br />drive be cut back to within eighteen inches of the <br />property line, stipulating that this situation must be <br />corrected within thirty days after receipt of the letter. <br />Motion unanimously carried.. <br />Councilman Steele moved, seconded by Councilman 'Lack, TRANSFER OF FUNDS <br />to approve the transfer of. $8,la.01.8~, from the Liouor Operating <br />Fund to the Liquor Sinking Fund. Motion carried. <br />Councilman Ecklund moved, seconded by Cour~ilman Black, to BID DATE - 1971 SEALCOATING <br />set the date for the Bid opening for 19711 Sealcoating in <br />the Southeast Quadrant for June 26, 1971, at 2:00 P.M. <br />Motion carried. <br />
