MINUTES OF SPECIAL COUNCIL MEETING FALCOTd HEIGHTS, MINNESOTA JIJI~JE 3, 1971w. A special meeting of the Falcon Heights City Council was called to order by Nlayor ylarkentien at 8:10 P.I~?. Mayor Warkentien, Councilmen B1ac?c, Ecklund, and Steele, PRE:~ENT Also present were Clerk-Administrator Barnes and Attorney Kenefick. None. Mr, and T?rs. Fred Gardner, 1880 Holton Avenue, were present to discuss possible Council action on the driveway at the residence of LeRoy Williams, 1886 Holton Avenue, which was widened an additional eighteen inches to the property line of the Gardners. The main concern is the snoVr that is Wiled near their home at 1880 Holton in the winter by the Williams', obstructing the basement t~rindows and which causes a water problem in the spring. Mrs. Gardner stated that she had contacted the City Ha11 regarding this problem and was told that Mrs. Williams had. been informed by the Building Inspector that in order to do this they would have to obtain a variance, as the City Ordinance requires driveways to be five feet from the property line, a.nd a1 so obtain a building permit, neither of which was procurred. The Gardner's request was that the driveway be cut back to two feet from the property line, and also cut it dot,m in height, as it was raised approximately three inches during the resurfacing. It was the Attorney's opinion that the Council could enforce the Ordinance and have the drive cut back to eighteen inches, but that there is no provision stating that a property otmer cannot increase the height of the drive, unless the natural drainage or the level at which the drive meets the street Vras changed. AB 5'ENT 4 '7 I~ DRIVEGJAY AT 1886 HOLTON Councilman B1a.ck moved, seconded by Councilman Ecklund, that the Attorney be instructed to ?~rrite to the Williams, at 1886 Holton Avenue, explaining that they are in violation of the ordinance, requesting that they obtain a building permit, a double fee will be charged, and also that the drive be cut back to within eighteen inches of the property line, stipulating that this situation must be corrected within thirty days after receipt of the letter. Motion unanimously carried.. Councilman Steele moved, seconded by Councilman 'Lack, TRANSFER OF FUNDS to approve the transfer of. $8,la.01.8~, from the Liouor Operating Fund to the Liquor Sinking Fund. Motion carried. Councilman Ecklund moved, seconded by Cour~ilman Black, to BID DATE - 1971 SEALCOATING set the date for the Bid opening for 19711 Sealcoating in the Southeast Quadrant for June 26, 1971, at 2:00 P.M. Motion carried.
