SPECIAL MEETING JULY 17th, 1958. ~-~~-'~~ <br />Meeting was called to order at 7:30 with the following Council Members present: <br />Harold C. Nilsen, Mayor; Geo. Shavor, Trustee; Willis Warkentien, Trustee; <br />Paul Coppini, Trustee; and Wm. R. Utecht, Clerk. Also present were Frank N. <br />Graham, Attorney and Ethel E. White, Deputy Clerk and Deputy Treasurer. <br />Minutes of the Special Meeting of June 30th were corrected to read "RTest Side of <br />Iowa" instead of "East side of Iowa", page 1027, 4th paragraph. <br />Minutes of the regular meeting of June 10th were approved as submitted. <br />A. E. Gerald Letter from Mr. Gerald. complaining about his driveway was read. <br />1478 Idaho Mayor Nilsen said he had contacted Geo. Hughes, Engr. for <br />TKDA& Associates who said he would go down and take a look at <br />it. Some work was done. Mr. Gerald is out of town at present <br />but Nilsen will contact him later. <br />Tatum St. Attorney Graham's letter was read advising that he had checked <br />the larr and finds that statue, Section 471.34 M. S. A., which <br />provides that where a village calls for bids "For the purchase <br />of any supplies or equipment" no bid shall be accepted unless com- <br />petitive bids have also been submitted, has been construed by the <br />Minnesota Supreme .Court not to cover contracts which include <br />furnishing work and labor in connection with the installation of <br />the supplies or equipment. See Otter Tail Power Co. v Village <br />of Elbow Lake (1951) 234 Minn. 419.49 N. W. 2nd. 197. This means <br />that even though only one bid is received in connection with the <br />proposed construction work on Tatum Street, it could be accepted <br />without violating the statute. <br />Attorney Grahsm's letter of July 17th was read wherein he stated <br />he was enclosing copies of Agreement Dated July 10th between the <br />Village of Falcon Heights and T. A. Schifsky & Sons covering the <br />Tatum St. Improvement, also 3 copies of Change Order #1, dated <br />July 8th, eliminating culverts on private property, 2 copies <br />Travelers Insurance Company Certificate of Insurance, as required, <br />and Public Contractor's bond of Maryland Casualty., dated July <br />14th in the amount of 166,47q.23. Graham advised he had checked <br />the foregoing papers and found them to be in order. He said the <br />Mayor and Clerk should execute the agreement for the Village, also <br />the Change Orders by signing all three of them. He suggested <br />that the papers be returned to him and he would see that a signed <br />copy of tY~e Agreement and Change Order are delivered to the con- <br />tractor, and to T~Ir. Ljungren. He also said he thought it would <br />be desirable that the Village's copy of the contract and change <br />order and the bond and insurance certificates be kept in his file <br />at the office. <br />Sanitary Copy of Attorney Graham's letter to L. H. Langevin, Manager Safe <br />Sewer Keeping Department, First National Bank of St. Paul, was read. <br />Improvement He advised Langevin he was enclosing 2 copies of a resolution <br />Bonds certified by the Village Clerk, passed by the Council Thursday, <br />July 10th, 1958, authmrizing the Safe Keeping Department of the <br />First National Bank, until instructed otherwise by resolution of <br />the Council, to clip and cancel the coupons on the Village of <br />Falcon Heights Sanitary Sewer System Improvement i3onds held in <br />Safe Keeping, as they become due and to cancel the bonds as they <br />become due, and to forward the cancelled bonds and the cancelled <br />coupons to the then Village Treasurer of the Village of Falcon <br />
