MINUTES <br />REGULAR CITY COUNCIL MEETING <br />FEBRUARY 11, 1987 <br />Baldwin opened the meeting at 7:05 P.M. <br />PRESENT <br />Baldwin, Ciernia, Chenoweth, and Wallin. Also present were Barnes, <br />Maurer, and Schroeder. <br />ABSENT <br />Hard (Arrived Later) <br />CONSENT AGENDA APPROVED <br />Ciernia moved, seconded by Wallin, approval of the Consent Agenda with the <br />removal of Item 11, Letter from Keith Heuer, 1840 Snelling, regarding <br />reimbursement for tree trimming. Motion carried unanimously. <br />MINUTES OF JANUARY 28, 1987 APPROVED <br />Ciernia moved, seconded by Wallin, approval of the Minutes of January 28, <br />1987. Motion carried unanimously. <br />APPROVAL OF VARIANCE REQUEST FROM EDWARD RUBES, 1877 HOLTON <br />Baldwin presented a variance request from Edward C. Kubes, 1877 Holton, to <br />expand his garage to within one foot of the lot line. Wallin explained <br />the Planning Commission approved the variance with the stipulation that <br />rain gutters be required on the structure with water draining to the <br />street, not on the adjoining property. Mr. Kubes assured he would comply, <br />after which Wallin moved, seconded by Ciernia approval of the variance <br />contingent upon compliance with conditions set forth by the Planning <br />Commission. Motion carried unanimously. <br />COOPERATIVE AGREEMENT WITH MN/DOT ON SNELLING AVENUE IMPROVEMENTS APPROVED <br />WITH CONDITIONS <br />Council reviewed items in the agreement which had been discussed at a <br />workshop with MN/DOT prior to the meeting, and expressed their concerns <br />and objections relating to the agreement. Council inquired if the bid for <br />the proposed new water service on the west side of Snelling is exorbitant, <br />and the city decides to delete that portion of the project, would the City <br />be expected to pay for administrative costs. Robert Cartford, MN/DOT <br />engineer replied in the negative. Following a lengthy discussion Council <br />agreed the following contingencies be added to the agreement: (1) <br />willingness clause be changed to reflect that the City sees no benef it <br />from upgrading the storm sewer north of Larpenteur on Minnesota State <br />Highway 51, but as a sign of good faith will cooperate up to 50 percent of <br />the present ascribed cost of $41,464, (2) State will retain ownership and <br />maintain the storm sewer on Minnesota State Highway 51, (3) State is <br />responsible for all landscaping or restoration costs, (4) City considers <br />at minimum that MN/'DOT will make a significant effort to enact changes <br />detailed in the letter dated February 1, 1987 to Terry Maurer, Maier, <br />Stewart and Associates, from Robert H. Cartford, Assistant District <br />Engineer, Minnesota department of Transportation, and letter dated January <br />28, 1987 from Bob Cihlar of St. Paul Water Department, and City retains <br />the right to contest any costs for adjustment of existing water utilities, <br />and (5) State will agree to payment schedule outlined by MN/DOT. <br />
