Memorandum of Agreement Field maintenance agreement between White Bear Lake Area Schools and the City of Hugo Term of Agreement: May 1, 2016 to August 1, 2016 The following is to serve as a Memorandum of Agreement between White Bear Lake Area Schools (WBLAS) and the City of Hugo (City). As part of this Agreement, WBLAS will provide ball field grooming services for the City at Lions Park and Diamond Point Park. In exchange for providing ball field grooming services, WBLAS will be allowed to use ball fields at Lions Park and Diamond Point Park during the term of this Agreement for Community Education programming purposes. Unless this Agreement specifically provides otherwise, the City will provide all services necessary to maintain the ball fields within the city limits of Hugo. WBLAS will undertake the following responsibilities: • Drag the aglime areas prior to all scheduled games, including weekend games, and at least one time per week when games are not scheduled; • Fill low spots in the aglime areas with aglime that is already present on the fields; • Chalk base lines as needed; • Coordinate field schedules and communicate schedules to field users; • Notify the City of concerns on the City fields; • Provide ball field chalk and soil drying agents; • Clean trash from bench areas and place in trash in City -provided receptacles; and • Repair any damage that WBLAS staff have caused to the property during maintenance. City will undertake the following responsibilities: • Supply appropriate amounts of aglime, as needed, for the care and maintenance of the ball fields; • Spread and grade ball fields when additional aglime is provided;; • Replace bases and pegs, pitching rubbers, and home plates; • Mow the City fields; • Evaluate grounds at Lions Park after Hugo Good Neighbor Days and identify safety concerns; • Empty all trash receptacles at the City fields; and • Repair, replace, and maintain benches, fencing, or any other structural items as necessary. Indemnification and Insurance. To the extent authorized by law, each party agrees that it will be responsible for the acts or omissions of its officials, agents, and employees, and the results thereof, in carrying out the terms of this Agreement, and that it shall not be responsible for the acts or omissions of other parties and the results thereof.
