result of demands, claims, judgments, or costs arising out of or caused by the indemnifying <br />party's negligence in the performance of its respective obligations under this Agreement. This <br />provision shall not be construed nor operate as a waiver of any applicable limitation of liability, <br />defenses, immunities, or exceptions by statute or common law. <br />In the event of any claims or actions filed against the parties jointly or separately for any of the <br />activities for which the parties are responsible for under this Agreement, nothing in this <br />Agreement shall be construed to allow a claimant to obtain separate judgments or stack <br />separate statutory liability caps from the parties jointly or separately. This Agreement is intended <br />to limit the liability of the parties jointly and separately. <br />Each party will maintain comprehensive liability insurance at its own expense throughout the <br />term of this Agreement against all claims for damage to persons or property arising out of the <br />parties' use of the City's ball fields or any part or parts thereof in limits no less than liability <br />limitations set forth in Minnesota Statutes section 466.04, for bodily injury, death, and property <br />damage in all instances. <br />Both organizations recognize that this agreement will solidify an already strong model of <br />government cooperation by continuing to provide services to the citizens and users of parks and <br />programs in the city of Hugo. <br />White Bear Lake Area Schools City of Hugo <br />Dr. Michael Lovett, Superintendent Bryan Bear, City Administrator <br />Date <br />2 <br />Date <br />
