Resolution 2016 - <br />Page 3 <br />h. The planned future trail along Elmcrest Avenue shall be constructed and paid for <br />by the developer. <br />i. Park dedication requirements for this site have been met with previous additions. <br />No additional park dedication is required for this phase. <br />Landscaping <br />J. The applicant shall revise the landscape plan to show the proposed 33 units. <br />Miscellaneous <br />k. The applicant shall comply with all conditions from the City Engineer's memo <br />dated April 21, 2016. <br />1. The developer must obtain all necessary stormwaten management and WCA <br />permits from the City. <br />m. The applicant shall complete an as -built survey of the stormwater pond south of <br />Rosemary way that serves this site. <br />n. The applicant shall provide copies of the development covenants/HOA documents <br />for City review. A copy of the covenants/HOA documents shall be filed with the <br />final plat. <br />o. The applicant shall provide copies of the cross access and maintenance <br />agreements for City review. These documents shall be recorded with the final <br />plat for the shared private drives and parking. <br />8. Prior to issuance of building permits, the applicant must comply with the following <br />conditions: <br />a. The homeowner's association documents shall include language to ensure that <br />the enclosed garage spaces are maintained for vehicle parking and that parking of <br />snowmobiles, boats, RVs and other recreational vehicles in the driveway is <br />discouraged. The covenants should be drafted to prohibit the storage of anything <br />in the garage or driveway that would prevent the storage and parking of vehicles. <br />b. The homeowner's association documents and sales information shall note that <br />the property to the north is zoned Agricultural (AG) and that the intent of this <br />district is to provide an area for the production of livestock, dairy animals, dairy <br />products, poultry or poultry products, fur -bearing animals, horticultural or <br />nursery stock, fruit, vegetables, forages, grains, timber, trees, or bees and apiary <br />products, and other uses dependent on the inherent productivity of the land. <br />c. The developer's architectural control committee (ARC) shall review and approve <br />all building designs for compliance with this resolution, prior to building permit <br />
