Hugo City Council Meeting Minutes for November 18, 2013 <br />Page 5 of 12 <br />conditions of the SUP and there is likely contamination on the property. Staff also <br />recommended Council approve an Order on the property that defines the steps to clean it up, <br />which begins with removal of all items on property and a Phase II Environmental Review to be <br />done by competent technical personnel. <br />Mayor Weidt opened the revocation hearing. <br />Business operator Dan Stewart stated he has been there for 20 years and became ill a year and a <br />half ago with kidney problem and is on dialysis every other day, along with a recent divorce. <br />Stewart stated it was hard to work every day, and he was not selling anything. The business has <br />been closed. He responded to the statements made by Preisler saying the pictures were over <br />exaggerated. He said he has a good rapport with the EPA and MCPA. The land owner has let a <br />different operator in the back of the property who made the mess with the gas tanks and <br />garbage, and he had a friend working to get the tanks out today. He said they do have <br />hazardous waste storage. There were no more tires. Three dumpsters were filled and the solid <br />waste was gone. Fire extinguishers were available and fifty -foot fire lanes existed. There is a <br />container for spills, and the cars come in already filled with trash. Stewart stated he had <br />reapplied for the Hazardous Waste Generators License and has been trying to get in touch with <br />Washington County. He finished the site plan today, and the wind keeps knocking the fence <br />down. Stewart said he just wants a place to work and keep it down to about 100 cars. He said <br />he has three employees with families. <br />Petryk asked about the tires and tanks. Stewart stated he has a receipt for the tires and he needs <br />enough plastic gas tanks to fill a semi so they are taken for free. They do not dump gas on the <br />ground because it is too expensive to waste. All tires were picked up out of the ditches, and the <br />place is cleaner than it's ever been. <br />Klein asked about the containment platform and whether fluids were caught in a localized area. <br />Stewart stated the concrete slab existed but the edges had been knocked off by the plow last <br />year. He is making a new stand that would be attached to the building. He stated he had only <br />processed around six cars in the last year and a half. <br />Bronk asked if it was fair to say that the pictures, if taken today, would be one -hundred percent <br />different. Stewart stated the tires were gone but he was still cleaning. <br />Petryk asked if he had been talking with staff. Stewart stated he gave the City the surety bond <br />today, which is effective until August 2014. He stated he has a site plan and two more <br />dumpsters of wood debris he hoped to get a burning permit from the Fire Marshal to burn. He <br />will get the Hazardous Waste Generators License and he already paid for the waste water <br />management plan. Stewart requested a little more time. <br />City Attorney Dave Snyder asked Mr. Stewart if the license had been terminated by Washington <br />County, and he said that it had. He also questioned Building Official Chuck Preisler on <br />statements made by Mr. Stewart and observations made during the recent inspection of the <br />property. Chuck stated that here were still tires on the site on Friday. A fire suppression system <br />may exist but is not clearly marked and posted. There may be a fire lane but it is not 40-50 feet. <br />Some fire lanes do exist now because a lot of the vehicles had been removed, and it may have <br />been compliant on Friday for the number of cars that were there.
