Minutes for the Hugo City Council Meeting on December 20, 2010 <br />Page 4 of 6 <br />Discussion on December 8, 2010 Rice Creek Watershed District Meeting and Removal or <br />Modification of Weir on Judicial Ditch #2 <br />Due to a potential conflict of interest, Mayor Miron removed himself from discussion and turned <br />the gavel over to Acting Mayor Petryk. <br />At its November 15, 2010 meeting, the Hugo City Council listened to a presentation from staff <br />regarding the Rice Creek Watershed District (RCWD) Board of Managers meeting and the topic <br />of the installation of the weir in Judicial Ditch No. 2. After discussion, Council directed City <br />staff to attend the upcoming Wednesday, December 8, 2010 RCWD meeting at which the Board <br />of Managers discussed the request from the Minnesota Department of Natural Resources to <br />remove the Weir on Judicial Ditch No. 2. City Attorney Dave Snyder attended the meeting and <br />reported to Council the action taken be the RCWD Board. <br />The RCWD Board passed a resolution of Findings and Order to Remove the Sheetpile Weir on <br />Judicial Ditch 2. The Order states that the sheetpile shall be modified so that it has no hydraulic <br />effect. Though the Order states that the interest and intent is to modify the weir, City Attorney <br />Snyder pointed out that it is contingent on permitting and approval of agencies that may not grant <br />it. Council referred the matter to City staff to evaluate and determine if any comment is <br />necessary to the DNR or other agencies. <br />Update on December 13, 2010 Lake Air/Bald Eagle Estate Neighborhood Meeting <br />On October 11, 2010, the City Council held a neighborhood meeting with residents in the Lake <br />Air Estates/Bald Eagle Estates neighborhood to discuss a potential street and utility improvement <br />project. The proposed project would include roadway reconstruction and could include the <br />installation of City water. At its October 18, 2010 meeting, Council directed staff to mail a <br />questionnaire to the residents within the project area to determine interest regarding the potential <br />road and water improvement project in their neighborhood, and on November 15, 2010, Council <br />directed staff to hold another meeting with the Lake Air/Bald Eagle Estates neighborhood <br />residents in order to share the results of the survey. This meeting was held on Monday, <br />December 13, 2010 and was attended by City staff and Council as well as 35 neighborhood <br />residents. <br />City Engineer Jay Kennedy explained to the Council that 78 questionnaires had been sent and 61 <br />were returned. The response was 25 want no project, 25 want a roadway project only, 5 want <br />both road and water, and 6 wanted water only. Those who wanted water only were part of the <br />Bald Eagle Townhome Association, and the water project could occur separately. Jay explained <br />a neighborhood leadership group was formed that evening, and they will be meeting in January <br />and they would continue discussions with City staff and Council. <br />Miron made motion, Weidt seconded, to direct the City Engineer, at a minimal cost, to do a <br />cursory review to identify whether water could be bypassed in the area and what affect that <br />would have on our water system. <br />All Ayes.
