kesolution 2014-25 <br />Page 2 <br />11. Prior to the release of the final plat for recording, the developer shall comply <br />with the following conditions: <br />a. All assessments shall be paid in full. <br />b. Outlot A shall be dedicated to the City to satisfy 77 % of the park dedication <br />requirement in Phase 1. The remaining 23% shall be paid in fee at Phase 2. <br />c. A segment of Finale Avenue right of way shall be dedicated to the City beginning <br />approximately 385 feet south of 145' Street right of way and extending to CSAH <br />8, with legal description subject to review and approval by staff. <br />d. A development agreement shall be signed and submitted in a form satisfactory to <br />the City. <br />e. The City's development fees shall be paid. The fee amounts will be calculated <br />and included as part of the Development Agreement. <br />12. Prior to the issuance of a building permit on Lot 1, Block 1, the developer shall <br />comply with the following conditions: <br />a. All items in the approval conditions for the site plan approved by the City on May <br />5, 2014, shall be met. (Resolution # 2014-13) <br />b. The applicant shall file the final plat, development agreement and associated <br />documents with Washington County. Proof of recording shall be provided to the <br />City. <br />c. The applicant shall submit one full set of approved final plans to the City. <br />d. The sewer and water trunk fees and the City's SAC and WAC fees shall be paid <br />with the building permit. <br />e. The developer must obtain all necessary stormwater management and WCA <br />permits from the City. <br />13. Prior to the issuance of the certificate of occupancy for the building on Lot 1, <br />Block 1, the developer shall comply with the following conditions: <br />a. Finale Avenue between 145a' Street and 146th Street shall be reconstructed as an <br />urban section roadway to a width of 26 feet with the first layer of bituminous. <br />b. A 10 foot wide trail easement shall be dedicated for the public trail. The exact <br />trail location shall be reviewed and approved by staff. The trail location shall be <br />setback 10 feet from the neighboring property to the west. <br />
