RESOLUTION 2010 -5 <br />APPROVING A PUD GENERAL PLAN FOR POSITIVE COMPANIES, INC. FOR <br />"POSITIVE" DEVELOPMENT ON PROPERTY LOCATED NORTH OF FRENCHMAN <br />ROAD (CSAH 8) AND EAST OF ELMCREST AVENUE NORTH <br />WHEREAS, Positive Companies, Inc. has requested approval of a PUD General Plan to allow <br />construction of approximately 11,933 square feet of commercial on 1.07 -acres of the property <br />legally described as follows: <br />Outlot A, Victor Gardens North Village 3rd Addition, Washington County, <br />Minnesota. <br />WHEREAS, the Planning Commission has reviewed the PUD general plan at a duly called <br />Public Hearing and recommends approval; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF HUGO, MINNESOTA, that it should and hereby does approve the request by Positive <br />Companies, Inc. for a PUD general plan, subject to the following conditions: <br />1. A PUD general plan/site plan is approved to allow development of 1 commercial lot for a <br />retail shopping center and 3 oudots, in accordance with the application received by the City <br />on May 21, 2009, and revised on January 28, 2010 and January 29, 2010, except as amended <br />by this resolution. <br />2. Approval is contingent upon City Council approval of the requested final plat. <br />3. The development shall be consistent with the Victor Gardens North P Addition approvals <br />(Resolution # 2006-19), except as otherwise noted herein. <br />4. Development standards for the PUD shall be as indicated on the plans and graphics dated <br />January 28, 2010 and January 29, 2010, except as amended by this resolution. <br />5. The retail building and parking shall comply with the setbacks as shown on the plans. <br />6. The commercial building must be sprinklered. <br />7. PUD flexibility is permitted to allow: <br />a. Signage on all 4 elevations where the PUD allows signage on only 2 elevations <br />b. Parking flexibility to provide 57 parking stalls where 68 stalls are required. <br />8. Prior to issuance of building permits, the applicant must comply with the following <br />conditions: <br />
