The applicant must provide proof that the final plat and all associated documents have <br />been filed at Washington County. <br />gg. The following documents must be submitted reviewed and approved by the City <br />Attorney. Upon City approval, the applicant shall file these documents at Washington <br />County: <br />1) Articles of Incorporation of Victor Gardens Third Association <br />2) Declaration of Covenants, Conditions and Restrictions of Victor Gardens Third <br />Association. <br />3) Amendment to the Declaration of Easements (Signage, Roadway, Access—North <br />Village) <br />4) Private Road, Easement And Maintenance Declaration <br />5) Trail Easement Documents. <br />6) Sidewalk Easement Documents. <br />7) Deed from the landowner to the City of Hugo for Outlot A and Outlot C, Positive. <br />hh. The applicant shall obtain all necessary local, state, and federal permits. <br />ii. One development identification sign (with no tenant signage) was approved for the east <br />side of the Kwik Trip site as shown on the Master Sign Plans. The Association has the <br />right to install this sign upon receipt of a sign permit. <br />9. Prior to issuance of a certificate of occupancy, the applicant must comply with the following <br />conditions: <br />a. The City provided the landowners with a punch list (dated July 14, 2009) of outstanding <br />development issues. <br />1) The property owners shall provide a summary of how the required improvements will <br />be made, by whom and schedule for the improvements. <br />2) These issues must be addressed prior to issuance of CO for this site and release of <br />financial guarantees. <br />ADOPTED by the City Council this 1 S` day of March 2010. \ <br />on, Mayor <br />ATTEST: <br />1 \ r <br />Mic ele Lindau, City Clerk <br />
