RESOLUTION 2010 - 6 <br />APPROVING A FINAL PLAT FOR POSITIVE COMPANIES, INC. FOR <br />"POSITIVE"ON PROPERTY LOCATED NORTH OF FRENCHMAN ROAD <br />(CSAR 8) AND EAST OF ELMCREST AVENUE NORTH <br />WHEREAS, Positive Companies, Inc. has requested approval of a final plat for <br />"Positive" to allow the construction of a lot with a shopping center and 3 outlots on the <br />4.26 -acre property legally described as follows: <br />Outlot A, Victor Gardens North Village 3rd Addition, Washington County, <br />Minnesota. <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request by Positive Companies, Inc. for a final plat, subject to the following findings and <br />conditions: <br />1. A Final Plat is approved to allow 1 lot and 3 outlots, in accordance with the <br />application received by the City on May 21, 2009, and revised on January 28, 2010 <br />and January 29, 2010, except as amended by this resolution. <br />2. Development standards shall be as approved Positive PUD general plan approvals <br />dated March 1, 2010. <br />3. Park dedication requirements for this site have been met with previous additions. No <br />additional park dedication is required for this phase. <br />4. The Everton AUAR fees for this site have been previously satisfied. No additional <br />payment is required. <br />5. Prior to the release of the final plat for recording, the developer must comply with the <br />following conditions: <br />a. The existing conditions survey should be revised to show the entire area proposed <br />to be platted. <br />b. The applicant shall dedicate a 10 -foot drainage and utility easement along the <br />south property line of the proposed Lot 1, adjacent to the north right-of-way line <br />of Frenchman Road North. <br />c. The applicant shall comply with all conditions from the City Engineer's memo <br />dated February 3, 2010. <br />d. The following documents must be submitted, reviewed and approved by the City <br />Attorney: <br />
