RESOLUTION 2010 - 6 APPROVING A FINAL PLAT FOR POSITIVE COMPANIES, INC. FOR "POSITIVE"ON PROPERTY LOCATED NORTH OF FRENCHMAN ROAD (CSAR 8) AND EAST OF ELMCREST AVENUE NORTH WHEREAS, Positive Companies, Inc. has requested approval of a final plat for "Positive" to allow the construction of a lot with a shopping center and 3 outlots on the 4.26 -acre property legally described as follows: Outlot A, Victor Gardens North Village 3rd Addition, Washington County, Minnesota. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the request by Positive Companies, Inc. for a final plat, subject to the following findings and conditions: 1. A Final Plat is approved to allow 1 lot and 3 outlots, in accordance with the application received by the City on May 21, 2009, and revised on January 28, 2010 and January 29, 2010, except as amended by this resolution. 2. Development standards shall be as approved Positive PUD general plan approvals dated March 1, 2010. 3. Park dedication requirements for this site have been met with previous additions. No additional park dedication is required for this phase. 4. The Everton AUAR fees for this site have been previously satisfied. No additional payment is required. 5. Prior to the release of the final plat for recording, the developer must comply with the following conditions: a. The existing conditions survey should be revised to show the entire area proposed to be platted. b. The applicant shall dedicate a 10 -foot drainage and utility easement along the south property line of the proposed Lot 1, adjacent to the north right-of-way line of Frenchman Road North. c. The applicant shall comply with all conditions from the City Engineer's memo dated February 3, 2010. d. The following documents must be submitted, reviewed and approved by the City Attorney:
